Hey everyone! Sorry I haven't gotten online lately to update my journey but man has it been fun! I filed my non PP lawsuit in local small claims a couple of months ago. Here in texas, if a company is sued they must be represented by an attorney. Well, I seem to have drawn one who is new out of law school because she has had her hands full! Shortly after filing, I was hit with demands for discovery in her attempt to run me off. I answered promptly and sent in my requests for discovery. In the mean time she sent her motion for venue transfer. Well, short story---She lost her motion for venue, failed to timely send my discovery back and now she is facing a hearing on the 21st for sanctions and summary judgement against her and her client I recieved a lovely letter offering $1,000 to just go away. It seems that paying a lawyer to fly here for the hearing is going to be somewhat expensive. Oh well. I asked for $1,000 before filing but now its just not what I'm looking for, especially since discovery eventually arrived late and showed several more violations. Now the suit is up to $5,000 and I'm feeling like there is about a 99 percent chance of winning at trial and 50/50 that the judge will grant sanctions and issue summary judgement on the 21st. The best thing is that I have learned how much I enjoy doing this. I've been looking into law school night classes. I think that this settlement will possibly go towards the first semester's classes. Awww, don't you feel sorry for that poor lil' ol' CA??? Having to spend all that money to defend themselves?? Now why couldn't you be a good little consumer and just play by the rulse they make up and forget that the law gives you rights??? I hope the Judge is thoroughly irritated that they can't seem to get their chit together and is in a real pissy mood.
