I'm posting alot today folks, just got my inverstigation report from TU today. I had previouisly dropped off old addresses with TU about 2 months ago. I then disputed my judgement and it came back verified. I was confused to how they verified it with the old addresses dropped off, so I called them and talk to the girl there, she says it was verifed by the name and address. I did'nt say anything else because I was shocked, I really did'nt know what to say. anyone have any advice on this judgement. I don't know what to do with it anymore kathy
Ugh...I wonder if others have had the same experience? I was successful using this technique - but maybe they've caught on that people are doing this..... I'd try disputing it one more time - it wouldn't be the first time that they didn't actually do the verification they were asked to do.
I know that this has worked for other people. I think that is way I'm so upset. I really should give everyone some insight with this judgement and maybe you folks can tell me were I went wrong. I know I did something wrong concerning this judgement. before I found this sight I pulled my credit reports (3-in-1 report). I proceeded to dispute several tradelines, which one of them was the judgement. (disputed as: I gave no reason). when I got back my investigative report it was deleted. I was jumping for joy, then I get a letter telling me it was re-inserted (not jumping for joy.), So I proceed to get the old address's knocked off, then I re-disputed again this time giving them the reason that it was not mine. well, that's the one I just got back as verified. Now let me give you the reason for this judgement. I lived in a privately owned apt house in the city. the Landlord was a real scum bag. He would walk in my apt when I was in the shower, so when I came out he would be standing there. he did this about 3 times. I called a lawyer and the lawyer send him a letter. about 1 1/2 months after him recieving this letter he files an eviction on me. I go to the hearing and can say nothing in my defense because I'm so young and intimadated at the time. I later found out that in PA they can file a judement right there at the hearing. I don't even remeber a judgement being filed against at the time., so I can't say it was not served right. So as a result I have not paid this judgement, I just resent the fact that this guy did this to me and now he is trying to get money out of me because he is a sleeze bag. I guess I'm going to have no choice but to pay this. I guess he get's away with it kathy
I wouldn't pay shit, call his home (if he is married) and ask for him when you know he isn't home. I would make his life soooo miserable. Then I would sit at his window where him and his wife sleep and knock on it whispering for him. I would send him pics of naked women from the web saying this was from last weekend and everything. Of course don't sign your name. Just say it was from Vasha from Russia.
Kiyi, I'm sitting here laughing my $ss off. this guys is a real creep. He makes me sick and he is still making me the victim, because he has ruined my credit. What does anyone think about trying to shoot for getting this judgement vacated. kathy
yah that would be pretty funny. Have a female friend write him a love letter and mail it out. Smear some perfume on it and maybe a lipstick kiss. Make sure you mail it from across town. Since an unpaid judgement sucks as much as a paid one I would just not pay it.
Well you all might think its funny, but he has no problem getting a cheap peek show and you not going any further with him, He then obtains a judgment on you for who knows what. Then god I don't know its pretty damn sleazy if you ask me. Sometimes you need to use something he doesn't have, like the boobies and the hooch, cause if you do it right, you could nail him real good and he will not have any proof stating he was innocent. cause when it comes to the booty call he has to prove he hasn't been cheating to his wife. This is EXACTLY the same thing he put you through without the wife, there is no way he could get out of it except for buying gifts for his wife, but I would made damn sure he would buy a gift with someone elses name on it LOL.
Kathy. Sorry to hear about your problem. Yes, this sucks. My take on landlord/tenant based credit problems is that you need to attack the source of the problems, the landlord, and not the effect, your credit. Landlords are very quick to sue and for very little amounts, much more so than financial institutions. Because you have a judgement against you, you should take it seriously and take the effort to get it taken of. Since you are here, you are starting that process. You are facing an uphill battle. But I think that it is one that needs to be fought. It is time to fight back. You need to fight two battles, each with their own laws, and possible courts. Please separate the issues in your mind so you don't confuse them. As I see it, you need to address two things. (1) The Financial Battle. This is were a court found for the landlord and awarded him the money he asked for. This is going to be difficult. The facts were presented (you did not present any), and they found that he was harmed. You defense of "not knowing what was going on" is not going to get you very far. (2) The tresspass & eviction. This is a tenant/landlord issue. This concerns the issue of the landlord violating your tenant rights, and the unlawful eviction. Your strategy should be to box him in and force him to reverse the judgement. I know that in your mind they are connected, and they are, but each deals with different laws. In otherwords, him seeing your boobs does not release you from the liability of carpet damange or unpaid rent. They are separate issues. I would focus on the landlord/tenant issue first. You goal needs to be to put him on the defensive as the landlord. I would learn your local tenant laws and bring suit against him for these violations. You might also want to bring forth tresspass and peeping tom criminal charges too. In addition, take a good look at the eviction. Was it lawful? Was it in retaliation for your complaint (obiously yes). What about the deposits? Did he hold them illegally too? You have one thing going for you, the record of the legal help you obtained concerning his tresspassing and voyurism (sp?). I think that you could have that same attorney bring forth a lawsuit for all this harm as a tenant. Once you have that lawsuit in place, you can then go after the judgement side of the war. You are very light on the details of the judgement. He evicted you and sued you. What did he sue for? Back rent? Damages? Now if you get the tenant battle won, then you can use that in one of two ways. (1) Use it to pressure him to drop everything, or (2) go ahead and use and sue the pants off of him. Once all that is done, you have effectivly removed the basis for his lawsuit that won him the judgement. You can then petition to have that judgement vacated. Please keep us advised of your progress.
Cable666, the amount of the judgement was for $1040.00. the last months rent was not paid, because I was going to court so I figured they would just get the money then. He filed eviction proceedings in the beginning of september and the hearing was at the end of September. (prettty quick). I thought everything was settled up at the court hearing, then I pull my reports in the beginning of this year and that is when I dicovered the judgement. I do realize that these are two separate issue's, but I feel that since this happend so long ago (3 years). that my case against him in the ways of harrassment will not be very solid. I, right now would rather deal with the judgement within itself, and try to get some resolution. I thought about calling the lawyer that sent him the letter to see if they can do anything. I'm sorry you waited 3 years to grow up. You are right. A 3 year old landlord/tenant case is going to be difficult. You should talk to the attorney that you used the first time and find out what your options are on the front. I still don't understand what happened. You chose not to pay rent when due at the first of the month. But you did not say if you ever paid it at the end of the month at the hearing. At that time you would have been almost a month past due. No wonder he won the case. The problem is, as my lawyer put it, "Judgements are forever". Since you made some dumb financial decisions at the time, you may be outta luck there. So, I'd look into an attack with the landlord/tentant violations. If possible, then use that to beat him into submission. The judgement is not very much. Can you pay it? Can you settle it?
Cable666, The rent was paid at the hearing. It was taken out of the escrow. Not to sound like I'm getting on the defensive but It did not take me 3 years to grow up. I had no idea how to handle matters like this and was to intimadated at the time to do anything else. I know alot more today and I'm learining everyday even more. We all make stupid mistakes when we are young. I'm very well aware that if I had the knowledge then, that I have now I probably would of won. As far as paying the judgement. I do not have that much money up front. The best that I could do would be to set up payments if that is at all possible. I don't have a problem paying the judgement because it is mine, but I have a problem with this having to stay on my report for 7 years, which basically there really is nothing I can do about it. this guy screwed my credit. because he is a piece of crap. kathy
Kathy, Don't forget to get the judgment vacated once it is paid. Judgements come back to haunt you if you plan to buy a house. Even if it is off your credit report the mortgage company will do a public record search. Good Luck.
