Used the "not mine" story....

    Disputed a charged-off account with the CRA's as "not mine" and it dropped off of 2. Other CRA has not responded back yet, but today I get a letter from the OC stating that after researching my dispute "we were unable to clearly determine your responsibility for the account......and informing the CRA's to report it as disputed pending further investigation." Along with this they sent an Affidavit of Fact - Fraudulent Credit Application form to fill out. So it seems that by disputing it as "not mine" my only option is to pursue this path which I am uneasy about doing. Any suggestions on what to do now since the OC said what they said and seem to only want to continue the process in this manner? Also, any chance that it will pop back up on the other two CRA's? Anyone ever run into this?

    Don't sign that, its a trick to make your credit report into a huge mess. Just tell them I don't need to sign it, if you can't verify it, delete it.

    That's right...federal law dictates if they can't verify in 30 days it is to be removed...not further investigated...or having you sign anything.

    It is thier responsibility to verify. There is no claus in the law for u to sign a verification. send them their form back along with a letter saying from the day they received your dispute, they only have 30 days or you get a deletion. If they mess up, instant law suit for you.

    Keep the original and send them a copy of the form. But ya'll knew that.

    What bizarre advice.

    Don't send the OC the original.
    Don't send them a copy.
    Don't send them money.
    Don't send them a xmas card.
    Don't send them anything.

    Wait 30 days. Then the item must be deleted. If it is not send the CRA a letter saying you did not verify, delete or I sue.
