    Asking for a friend.
    Can a CA sue before validating?

    Friend wants to know:
    Is it a violation of the fdcpa for a CA or creditor to contact you instead of your legal rep.after you have informed them of this fact??

    PS The CA included the 30day notice in with the suit.
    Can the CA file suit at the same time or before they send the 30 day notice of debt?
    Please help friend is desperate.

    Yes they can. Go to the ftc website and look at the fdcpa opinion letters. I don't remember which one it is but it is there.

    So if they sue first it pretty much blows your right to validation and your rights under the FDCPA right?
