Validation and Knots

    I sent off my validation letters today. Anyone else have knots when they walked into the post office? Don't know what I was afraid of, guess I thought the CA's would jump out and get me. How pathetic is that.

    I share the feeling, but also a feeling of satisfaction knowing that I'm working in the right direction to get my credit cleaned up.

    Wait until the green cards come back, and I bet you'll have a smug little smile on your face knowing what will come next!!!

    You're looking at it the wrong way. Every time you invoke your rights under FCRA or FDCPA you are giving the other side an excuse and an opportunity to violate the law, and you then get an opportunity of relieveing their overweight, bloated bank accounts of $1000 and transferring it to yours.

    Fear? Heck, I look at it as an opportunity. I PRAY for the day one of my creditors screws with me.

    For me validation is for buying time. I wish I were doing it for other reasons :(

    I received my first attempt of a validation today. I sent the validation letter recommended and the only thing they sent me back were my statements up to August 02.

    I've made payments through the collection agency since that time and there is no posting of payment activity.

    My balance has continued to climb. They did not comply with the request on my validation letter since again all I received was copies of statements.

    What is the next step?

    Rite: If anybody should get knots from a validation letter it should be the CA!

    Because they didnt' send me the info I requested it is a violation? Where do i go from here. Should the creditor have records of the payments I paid to the CA? If that is the case why is the 700.00 I paid since that time not accounted for?

    Jlynn, Lbrown, Flygirl..anyone, where do I go from here.

    Thanks LBrown. To CA correct?

    It's also been over 30 days since my green receipts were received on my other 3 accounts, is my next steap an estoppel with them as well?

    The failure to provide the validation is not a violation, but to continue to report and not mark the account as "in dispute" is a violation. The validation should have every payment and balance listed, as well as any contracts that were signed to prove that 1) this is your account and 2) you owe what they say you owe. The OC won't have a record of what you paid the CA, but the CA should have a record of all the payments made to them. As well as the CA will have to contact the OC in order to obtain the original agreement with the OC, any documents that prove that the CA can collect on behalf of the OC, your contract or some agreement that proves that this is your account, and a host of other things. Do a search on "what is validation" for the skinny.

    2*Why when they didn't validate? If you were going to just pay up anyway why did you even bother with sending a validation letter? Also why are you giving them payments when they aren't giving you credit for them?
    3*Must be adding the payments as charges - wouldn't you be ahead to just keep the payments?
    4*So why are you paying on a debt they can't prove?
    5*Estoppel 30 days after you got the green card back.
