Validation directly w/Experain

    Hi...

    I have the following question....

    Just got off the phone w/ Exp..in regards to my charged off accounts which (last activity was 12/96) reported by (Bank One) original creditor and also by the CA (Arrow Financial). Disputes from OC & CA came back verified with the 12/96 dates as charged off. As Per Exp, account must remain until 12/03
    (7 years)......SOL in the state of FL 4 years..

    Can I legally send a validation letter to the CA & OC or should I just let it slide until 12/03. My plans are to buy a home by August...

    You should have validated with the CA first.
    This is the second time I've seen someone make this mistake since yesterday.
    You could have gotten the CA on a 1000 buck violation.

    Why should MAYFLOWER have disputed with CA first? I thought the best first step was to dispute with CRA first, then go to CA. Can you give some advice on when to go to CRA first, and when to go to CA or OC first? (I'll be starting my repairing soon, and I don't want to make the same mistakes)

    Thank you for the info...

    Since I'm new at this... sometimes it gets confusing I don't want to send out the wrong letter...

    I will send out a debt validation letter to OC & CA today to be delivered tomorrow. If if comes back not validated (30 days) that mean OC & CA will remove charged off from EXP?

    What was meant by the $1k is this.

    1st step validate with the CA (OC do not have to validate)

    2nd step, once green card is received, dispute with the CRA.

    If during this time, the CA verifies with the CRA and not with you, that is violation number 1. If the CA pulls a credit report to confirm what you are asking about, that is a non-pp, violation #2. If the CA asks you for more information but verifies with the CRA, this is a biggy.. If the CRA does not receive info from CA, they have to dispute w/in 30 days.

    You can take the CA off to court and demand deletion for the above violations. Or you can be a hard be-hind and go for money and deletion. CA are stupid and will verify but not validate, it is almost a given in some instances.

    I am still a newbie but this strategy has gotten 3 CA removed from my reports. I like to follow it with an ITS letter for verification without proper validation letter. Very simple and they kind of start thinking you are a screw ball.

    OK, so you're saying validate with the CA and monitor CRA to make sure they don't verify or validate with them? Where can I get more detailed info on the violations for CA doing this?

    Look it this way:
    The CA is the horse.
    The CRA is the Cart.
    Which one always goes first?

    OK here is why
    1*But isn't that what he wanted anyway, validation from them?
    2*Therefore my assumption (correct me if I"m wrong) would be he should see if he can go thru the credit bureaus 1st to have it removed.
    3*Don't you normally pursue the credit bureaus first?
    4*Then if it is verified then you would seek validation from the collection agencies? That would be my course of action.

    2*Wrong order.Step 1 Send validation to CA .Step 2 Dispute with CRA after getting green card back.
    If CA verifies with CRA before validating with you you have the CA on their first $1000 violation.If CA fails to note as DISPUTED you have the CA on a second $1000 violation.
    If the CRA don't mark in dispute you have the CRA on a $1000 violation.At this point they have racked up $3000 in violations.
    3*And loose this chance to rack up these violations,no way!
    4*Wrong course as explained in 2 & 3.

    In situations like this when the acct listed is 6 or more years old, I recommend disputing first. Usually a ca will not bother with verifying an acct that old and it is usually deleted. A 1 or 2 year old derog will be more difficult to remove so that is when you validate first, dispute second.
