    GOOD NEWS!!!

    got EQ's response to my reinvestigation request....and they DELETED the collection!!!

    i was soooooo happy when i read the letter today.

    only thing is, it's dated March 24th and i mailed by 2nd dispute letter (3rd request overall) to them on the 26th. do you think this will have any effect on the deletion????

    UPDATE

    i got this letter in response to my first validation letter sent to OMNI (CA) on 03-18-04 :

    Dear Mr. Dilla:

    I am in receipt of you letter dated March 18, 2004 regarding the account referenced above. You have questions concerning the account and have requested validation of the balance owed. I will address the issues raised within your letter in chronological order.

    You indicated that you are unaware of any communication with you by this office. For your records, letters were mailed to your attention on 1/26/01, 2/12/01, 3/6/01 and 7/3/01. None of those letters were returned to this office. THIS DOESN'T MEAN I EVER RECEIVED THEM!!!

    Further, you have requested validation of the outstanding debt and charges. In speaking with our client, they have confirmed the information on the account including the social security number listed. The billing statement enclosed provides you with the information you have requested concerning this charge. (THE "BILLING STATEMENT" THEY ENCLOSED IS A LIST OF CHARGES THAT ARE ALL RE-AGED WITH 3/23/04 AS THE NEW DATE AND LISTING 04/6/04 AS THE DATE BY WHICH PAYMENT IS DUE!!! IN ADDITION, BOTH THE FIRST AND LAST NAMES LISTED ARE INCORRECT AND THERE IS NO SOCIAL SECURITY NUMBER ON THE BILL)

    In regards to your final statements relative to collection activity and credit bureau reporting, this information has been confirmed by the client and as such the credit bureau reporting will be maintained. As we have a billing statement from the client, your claims of "unsubstantiated demands" are without merit. Further, this organization is under no obligation to complete any documentation you forwarded with your letter referenced above. Please take a look at 15 US Code 1692 to review what steps are required of a licensed collection agency.

    If you have any questions or required any additional information, please do not hesitate to contact me.

    Equifax sent me a letter saying "This item has been deleted from the credit file" dated 03-24-04. The validation response from the CA is dated 04-12-04. i haven't received anything further from Equifax.

    Also, i haven't received any alerts from identityguard.com (where i monitor my reports) stating that the collection was deleted.

    I'm kinda lost now and could really use some direction. I'm not sure what my next step should be.

    Did you send documents too? What do they mean by "complete" the documents?

    -Unfortuneatly you have encountered A WELL INFORMED debt collector. HE IS RIGHT ON!

    -They received your TARDY validation notice and sent verification which was "responsive to the request of the consumer" EVEN THOUGH THEY WERE NOT REQUIRED TO BY LAW.

    -I would agree that the statements they did send were "weak" but probably NOT actionable EVEN IF YOUR VALIDATION REQUEST WAS TIMELY.

    -Unfortunately, this is a great example of why NOT to send letters found on the internet.

    -Remind anyone of Mahon case ?:)

    -DE JA VUE to Mahon anyone :)

    -As crappy as it sounds, they ONLY have to show they have a "mailing system" in place and they SENT the comminication. RECEIPT is not required.

    -If the reporting agency deleted the account, you should leave it alone :)

    i would love to!! after all, a deletion is what i'm after. trouble is the "deletion" letter is dated March 24th and i mailed them my 2nd dispute letter on the 26th. and the letter from the CA is dated April 12th. i haven't seen the deletion on my report yet.

    i'm getting really sick of all this back and forth and i'm just about ready to hire a professional (provided i can find a good one) to handle this for me. i really don't have that much to fix; a walk in the park for any lawyer, but i don't have the time. i'm working a lot and DW and i are going to have our 1st child in november...so things are pretty hectic.

    i've put a lot of time and a good deal of money into this so far, and i'm just worried that i might have screwed myself. i need some good advice.

    Epdilla,

    I dont think you have screwed youself. Just a little misdirected:)

    Your dispute is with the reporting agency. All the points are valid, but are lost when disputing with the furnisher.

    Try a detailed dispute with the reporting agency, if this one doesnt result in deletion :)
