Validation - got back altered notes

    Hi Everyone,

    I got a strange response to a validation request for FOUR student loan notes which I requested from ACS collections.

    You will not believe this but instead of sending me copies of all four original promisary notes, they sent me 4 but 3 were IDENTICAL copies except they altered them and wrote in different account numbers(you can see where they must have used white out and wrote in a different account number) - but the amounts on the three are all the same ($2444, $2444, $2444) There is a fourth note for 7500 which looks unchanged (but who knows)


    In essence she only had the notes for TWO accounts in amounts of $2444, and $7500.


    Can you guys believe the nerve of these people??
    What should I do at this point???

    I would go talk to a lawyer. If they did indeed forge these, they are in deep caca. In addition to FDCPA violations, this may also be fraud.

    Absolutely, I would get a lawyer on this ASAP... any attempt to alter documents should be A+ lawsuit material and may very well get you a discharge- who do they think they are fooling??

    I am with you sal- you and I are battling similar student loan issues... keep at 'em

    Also, have you asked them to send you other documentation for the loans?

    LKH, Kit, thanks for responding.

    There's so many issues I have with these school loans I don't know where to begin. But to make it short and to the point, I've been trying to get a refund from the school of which I took these loans out for (They closed up, and apparently either destroyed or lost all my records - bottom line is I never finished the school but they got ALL the money) I also found out that I had 2 pell grants totalling 5700 awarded to me but never applied to my loans - where did it go?? And of course they seized my tax returns for a sum of $2500 - and there is no trace of where that went.

    As far as those ALTERED notes go, they made sure that they gave them all seperate account numbers so they could place ALL of them on my credit reports and ruin me.

    QUESTION: Why is it that when I sent out validation requests to California Student Aid and USA Funds, I got the response back from ACS collections??? and then I get everything altered. (If any of you want to see them, I would be more then happy to email it - I have nothing to hide......you wont believe you're eyes)

    NEXT STRATEGY: I was thinking I would send my estoppel letter out to all these slime and see if they return me with more amunition for court (Would any of you agree with me, or should I do something else?)

    I swear I will take this to court if I have to, I'm way beyond playing games at this point.


    P.S. KIT, you need to keep me posted as to what is going on with you're loans, it sounds strangely similar to my situation.

    Yes, it most definitely does sound strangely similar... even more so since reading your post here. How did you find out about the Pell Grant being disbursed to the school? this may be something I want to look into. also, if you don't mind... when were these loans taken and when did the school close?

    Kit,

    My loans were taken out in early 1998. The school closed march of last year.

    Have you tried the state licensing agency to see if they have the school records?? they should if it closed down last year.
