validation question semi long

    i sent a validation letter to a medical collector who currently has 5 collections on me they sent back my original letter demanding proof but not the list of things that i required. and 5 itemized statements with this cover letter attached is a copy of the itemized statement you requested from our office. please contact the account representive listed below to discuss your accounts....... this is not what i asked for can someone give me a sample letter to follow up on one of these accounts also has a 0 balance the stamped everypage including the letter i sent to them so will keep it any suggestions i tried to negoitiate payment for deletion about a year ago and they told me no way.. also my health insurance paid out on these do i no longer have rights?????

    Not proper validation if they did not answer your other questions...for instance they are required to prove to you that they (the CA) are allowed to collect on the debt. All of those "assignment" questions on the validation response form are there for a reason. After all if they were NOT required to provide such proof, what is to prevent say - me - from attempting to collect on my neighbors charged off credit card after I hear him say he was late on a few payments and they closed his account. I mean all I have to do is send him a letter saying "You now OWE ME THE MONEY, NOW I AM THE COLLECTOR, PAY UP". Kinda makes you really understand why all these rules are there in the first place huh?

    The CA is required to prove they are legitimately able to collect for the debt. Even that you authorized them to, by signing something allowing the debt to be re-assigned or re-sold and remain as "your debt".

    Simply sending you copies of old statements, is NOT adequate validation of the debt you owe. Hell, it is not even validation there IS a debt anymore, or that they are able to collect it if it were. Now you must be creative in your validation demands though. After all now you KNOW they have at least some paperwork...make sure you say the right things and do not slip up and say something they can prove is false.

    Marie has an excellent follow up to the first and second validation letter when things were not correctly validated...

    You may have to alter the words like when it says "they have failed to provide ANY proof" you should change to "ADEQUATE" proof. Make them know in NO UNCERTAIN TERMS what you require, as your rights entitle you to require, from the CA. As Marie says, make certain you spell out "Exactly what you require and exactly what you want them to do" - send adequate proof or remove the item immediately.

    i thought at one time i had seen a letter requesting documentation with my signature and other proof.. also my insurance paid out on these isnt that proof enough??

    Are you saying your insurance paid this bill - therefore you don't owe it? Or that your insurance paid on this bill, and that could be used as proof that the debt is yours?

    Can you clarify?

    I doubt they have the insurance information. But, if you really don't owe this because your insurance paid it, I can help you withit.

    the insurance paid most the balances are like 30.00 one is for 10.00 i begged payment for deletion but they refused and they do have the insurance information.. which is under my husbands name not mine.

    Send the second letter - tell them they have failed to validate - no signature.

    ok breeze i will but do they have me on the insurance thing do you think... i am not worried about them suing me the total on all 5 accounts is less than 150 i just want the delete but i dont want to look stupid because of the insurance paying them most of the money
