I sent Credit Store validation letter on Feb 6th. I got a letter from them today, dated Feb 6th, stating they got my correspondence and that they have to order the original account info from the original creditor. They also said it may take more than 30 days to do so. What do I do once we reach 30 days and they have not yet validated?
I thought the estoppel letter was used when the CA did not respond at all to validation request. This CA responded by saying they are ordering the original account info. So you're saying the estoppel letter still applies?
Another thought. The collection account on my EQ report still does not say "consumer disputes account info". How soon does the CA have to update with this notation? Do they have a day, a week, a month?
Don't quote me but I believe they have 5 days to report the dispute to the cra. Now, they may have done it as it can take up to 30 days for the cra to update it.
If that is the case, then there really is no way to get the CA on a violation of this statute is there?
If they don't respond to your validation and you send estoppel and it still doesn't show disputed by consumer, then I'd say you got them. If it was me, and it wasn't showing as disputed at the end of 30 days, I'd try to nail them on it. The up to 30 days bit is what equifax told me this week. Gulf state readded a collection that showed up last week. I found out it was reported on 2/2 and appeared on 2/6. On 2/7 a UDF supposedly was faxed to the cra's to have it removed. As of today 2/15, it is still on all reports. And, Gulf State swore they sent me a copy of the UDF with a letter stating the acct. was closed and they were removing all derogs. They claim to have mailed it on Monday. Not in todays mail. Again.
Let's talk symantics. Define "respond". Does the fact that they sent me a letter stating they received my dispute mean they "responded"? Or does "respond" mean they have to actually tell me "yes" it's yours or "no" it's not?
Respond means they have complied with the request in the validation. A letter stating they received your dispute does not mean they have responded to the validation.
