I recently requested validation from a Credit Agency for a item a bit over 2 years old. As it turned out, the CA promptly validated the dispute, but here is where the question comes into play. If the validation clearly states that My X-Wife is the person responsible for this account (It is even checked on the form they sent me that we are divorced), how are they able to ding my credit as if my X and I are still married (Credit shows Joint with XWifes Name)? The dispute was from a dental office where my child was receiving treatment and I as a result of my divorce, I was responsible for providing insurance which I did and all insurance obligations were met. It looks like my X made all payments but the last one most likely due to her moving away and the payment getting lost in the shuffle. I would have gladly payed the remainder which is only 154.00, but was not aware of this until after the fact. Am I at fault here? I signed nothing and the original form clearly states my X is the person responsible for this account? What should my next step be if any to clear this from my credit history? Thanks in advance for any help.

    Additional Info

The CA did not return disclosure request form I requested along with my Validation request. Does this work for me in any way?

1*By credit what do you mean.?
2*The form or the bill ?

IS your name signature or address on any bill invoice contract etc?

Credit = Credit Report from Equifax shows Joint with X's name

My name was filled in by my X because the dental offices form requests the fathers name as well as the name of the insured person which was me. However there is a line that asks for the person responsible for the account and that is not me. I was never made aware of this problem until after the fact. I signed nothing and my address is not on the form.

    This is very interesting.

I had something very similar happen to me, and since back then I knew nothing about CN or about my rights, I just took the ding and suffered for 7 years for it.

Similar situation, back when I was married, we ahd taken one or both of our children to the local hospital before. They entered into their records/database my and her name and the name of the kids and my insurance info. This was years ago.

Then, few years later, we separate, and for a short while the ex had temp custody. She had taken one of my kids to the hospital, but of course I did not know about it.

When they pulled up her name, or actually the name of the child, their computers had me and my insurance info still in there, so my ex just goes and tells them "oh yeah, just bill his insurance and I'll pay the difference."

Well, I don't know wha happened, but I never saw anything from the insurance company. I think I had moved twice since the address the hospital had.

Anyhow, I find out by pure luck when I pulled my CR one day, that I had this medical collection against me, and get this, for about $25.00 !!!

When I called the hospital, they told me about the visit from like 1 or 2 years ago. It was the ex who signed the papers, but they said that since I had the insurance and since I was the child's father, that I was still liable/legally responsible to pay the bill.

I told the hospital that I NEVER, EVER even knew about the bill and that it was my ex who signed him in and signed the papers, etc .... but they refused to listen and told me I'd have to work this out with the CA they used.

At the time I thought the best thing was to pay it off quickly, and I did, but the CA refused to remove this and I knew nothing about requesting Validation or for Deletion.

I don't see how they got away with this (yes I do, I was dumb.)

I think this is a very big problem, hospitals and doctors keep records in their database, and when a child is brought in by one parent and the other doesn't know, the doctor assumes both parties know and they incorrectly assume that the parent who carried insurance is suppose to the the responsible party for the bill

My separation aggreement stated that all medical bills not covered under insurance were to be split 50/50, and that the one parent had to actually present the bill to the other in order to obligate them to pay their half.

Well, my ex never did this, and the hospital incorrectly assumed that since my name was already in their database and I was the father, that I had legal obligation to pay the bill.

Forget the fact I never knew about it nor ever received any bills. And of course the hospital told me the best thing to do is to quickly run over to the CA and pay it off. Then the CA didn't want to hear anything either, they just got the money and proceeded to report this for 7 years.

It dropped off in 1999 I think.
