Validation response.....(kinda long

    Been lurking for some time, and I must first say thanks for the tremendous amount of info that you guys give....:)

    I may have mad a mistake on this, so please help me out here. Last summer, I attempted to make good on an old, unpaid phone bill, and was referred to a CA that the account had been assigned to. In speaking with them, I made arrangements with them pay off in payments. I gave them my checking acct over the phone for drafts for payment, which I know now was wrong on my part. Made 1 payment and left it at that. Fortunately, they haven't drafted any more since then.

    I don't have problem paying this off now but I'd much rather deal with phone co., than CA.

    So, sent validation letter CRR to CA on 12/31. Signed for on 1/4. This is for an unpaid coll acct reported 9/99.

    They returned the 2nd page of the validation letter, only completing the sections that pertained to the information of the account. (orig creditor, acct #, amt of debt, date payable, etc)

    The also enclosed 2 identical forms with different dates that are demands for payment. One dated 7/2001 and the other dated 1/2002. The only difference besides the date is the balance due, the more recently dated one is minus the 1 pmt I made.

    They obviously didn't provide proper validation (I think), but did I screw up by making that one payment? Any help here is more than appreciated.

    No, they didn't send any proof, nothing with signature, or any statements or explanation of bill. The amount corresponds with the phone co., and it doesn't appear to include any interest charges or fees.

    In sending the estoppel, should I wait the 30 days? Or do you think I should treat the collection notices as possible violations.

    They sent him -her 2 collection letters with their response to the Val. L. Isn't this 2 Violations?

    I got 4 calls after a Ca signed the green card.on 12/26/01.
    Still no Validation.to date.
    Do I have them on 4 violations?

    The amount they are trying to collect from me is only $75.00.
    Wonder how much they are willing to spend for 75 bucks?

    Yesterday, my hubby received a collection letter on an account that did not validate.

    I am ready to follow through. Do we have to send estoppel? I am not the paitent type. Since they have already violated the law, can I just file suit against them?

    Is the 30 days from when they got the Gr. Cd. up yet.
    I think I would send the estoppel after 30 days are up.
    It may allow you to catch the CA & or CRA in additional violations.Anybody correct me if I'm wrong on this!

    You could, but I don't know how far you'd get with that at this point. I would go ahead and send the estoppel. It's obvious they aren't going to validate. Then send all copies to the cra and if the ca refuses to delete and verifies it, then sue them.

    The 30 days is up. I will go ahead and send the estoppel.

    Sometimes I have a hard time playing by the rules!

    I like to be done with projects!
