I am trying to get an old (96) repo off TL. OC is Nissan Motor, they sold to Gulf State who sold it to Sherman. All three show up on CR as open. I sent validation letters to all three plus disputed it with credit Bureaus. Gulf State (OSI) sent me a letter stating that the account was sold to Sherman and that I would need to contact them regarding my dispute. I still haven't received any validation from Sherman or Nissan, BUT Sherman is now gone from my EQ report. Is it possible to get the OC and Gulf State off of TL also?? I just don't get how they show an OPEN account if they no longer even have the account. I'm still new at this and this is my 1st attempt to get anything removed. Thanks!!
It makes no difference that OSI sold it to somebody else, if their tradeline is still on your credit report you can demand validation and if they don't provide it in a reasonable time you can file a lawsuit on them.
Simple validation letters without most of the garbage usually included in the commonly available sample letters is usually the best way to go. I believe that above all such letters should not say anything that could be seen as attempting to educate the 3rd party collector what his legal duties or requirements might be. I believe that a simple demand for validation would be much better than a bunch of legal sounding gobble-de-gook.
