I've read all the posts about validation and so on, and I have one question. Do we, as consumers, have the right to ask for validation of debt outside the 30-day period? And from the original creditor? I know there are alot of people on here who like me, have a small charge-off (of $500-$1000) which has ballooned into something much larger (past due $2500-$4000) over the years and we want to validate the debt to see how it came to be so large on the CR now. Can we do this? And if the original creditor doesn't respond, can we ask for deletion? Thanks.
-GREAT QUESTION! -YES, the consumer has a right to ask for anything at anytime. BUT IF IT IS OUT OF THE VALIDATION PERIOD, THERE IS NOT MUCH A CONSUMER CAN DO if they dont respond. -If the dispute is that the AMOUNT is incorrect, or unexplained, then you can dispute this with the reporting agency, being VERY SPECIFIC about the dispute. For example, if you had a charge off og $500.00, but it is listed as $700.00, THEN THE DIFFERENCE is the dispute. You need to question HOW the difference is calculated.

Then too how is a 500 dollar charge off better than a $700 charge off? Is the degree of the severiaty of a Derog measured by the dollar amount of it? Re: Re: Validation? -I think you all missed the point -The dispute of the account is the DIFFERENCE in the "true amount" and the reported amount, as opposed to "not-mine." -Yes, you are admitting to the "500$" debt. BUT, THIS IS IRRELEVENT. -Regarless of the liability, the consumer has remedy under the federal laws. If the reporting agency/furnisher of info VERIFIES the INCORRECT account balance, or cannot show HOW they came to the balance, then the consumer can sue them both. -And since INJUNCTIVE/DECLARITORY relief IS AVAILABLE under the acts, the consumer can sue for $$$, AND have the court order the reporting agency/furnisher to DELETE the account, you win x 2 -So yes, you are admitting to the 500$ account, but getting $$$ for the strict liability statute, and the account removed. -
