i had talked to a ca about my balance he said it was correct i ask for a statement and was told [we don't do that].checking my credit report it was listed as a dispute which it was't i thought it had to be written.
They can update the credit reporting agency to show in dispute. Creditors and collection agencies do that if the consumer disputes directly with them. You don't have to have a dispute in through the credit bureau for it to get updated. If you want a statement of the billing then send them a debt validation letter.
this was discharged in a bk 7.how ever i only asked for balance was told they would tell me when it's paid
You say discharged, are you sure they are listed in the schedule on the bankruptcy papers? I find people make that mistake a lot. Better be safe then sorry. Is the account listing on the credit report showing a balance? It should not be. It should show zero balance / included in bk. Should get a copy of the bk papers and forward a copy of the schedule F showing the creditor or collection agency included in bankruptcy and a copy of the discharge. Ask them to update the credit reporting agency to show zero balance / discharged. You can send them a request for debt validation. If you really need to know the correct amount. Have you tried calling back to see if you get a different person to help you, sometimes you can get further just by changing the person you are talking with.
Whoa!!! Discharged in bankruptcy??? CAs can NOT collect a debt that was previously discharged. I think you ran into a CA that bought charged off debts from a creditor, and that creditor did not make any note that it was an account legally discharged. If the CA hassles you about it, send them a copy of the creditor listing and your discharge document, and tell them to go jump into shark infested waters or jump out of an airplane without a parachute.
not only that it was my husband's not mine 'my husband has a diffenent issue wamu agreed to a program though cambridge accepted 2 payments then charged off.
Did you file joint on the bankruptcy? Do you live in a property state? Sometimes they mess up, you can contact them and inform them that this is not your debt. Tell them it is your spouse and that you want them to remove this from the credit report.
it was a joint bk and i believe idaho is a property state we each had our on card we very seldom had joint card's
I am not up on property state rules, but sometimes creditors can go after both parties to collect on a debt. Maybe someone else can chime in. You should be able to just send them bk papers and at the least have it updated to show zero balance. You can always dispute with the credit reporting agency "not mine" and see if they remove.
If it was discharged in bankruptcy, you owe nothing. There is no balance. Contact your bankruptcy attorney and ask him or her to deal with this. A strongly worded letter should take care of it.
