confused Out of this kind of a mess one somehow has to extract some grain of common sense. There really no alternatives. There are those times when one has to get just as stupid as they are. Now then, if I understand correctly PACBELL says they never turned you over to any such collection agency and you say you have never defaulted with them. That much you seem to have accomplished. I would tend to think the next step might be to get Pacbell to send you a written statement to that effect then with the apparent proof that they have turned you over to a collection agency and caused you damage to your credit reports I would then send a letter to pacbell telliing them that if they don't straighten this mess out you will file suit against them for defamation of character. Of course, you would not actually do that because defamation of character would not quite be the correct charge to bring but who cares about little details like that at the start of the fight. You can get down to brass tacks later if need be but I'd almost be willing to bet they will do something about it. What the heck else can you do at this stage of the game? If Pacbell will go to bat for you under threat of lawsuit then you might want to bring a case against the collection agency but worry about that later. Right now thats about the only way I can think of because you can't go to court very easily if you don't have the documentation from the OC in this kind of situation.
Working on them right now I am working on this right now. The issue is that Pacbell no longer does business with this CA. Also, they have been taken over by SBC so this is becoming my little nightmare over here. You would think that businesses would be more organized..hmmm but anyway. I am working this one out. I am not worried, I have the luck of the idiots on my side.

They have to get married before a judge first because the Mexican Government don't recognize the church so in the eyes of the Mexican court system if you only got married in church you are not legally married. And the Catholic church don't recognize the Mexican government or any other government except the government of the Catholic church you have to get married in Church or you are not married in the eyes of God and are living in sin. As a result you would surely be condemned to eternal damnation and your kids would all be little bast*_-$ until at least the 7th generation or something like that. Not to mention that they may very well be little B*&^%$#@ anyway, at least figuratively speaking. (LOL) She isn't Catholic any more but belongs to a Mexican Pentecostal church which hates the Catholic church with a purple passion but still believes much the same way the Catholics do even though they won't admit they do. So now we gotta get married in her church or we are living in sin after 25 years. Still, she would not dare get a divorce even if she wanted to because that would be sin too. God probably loves her either way. And so do I.

I will clearly state that this liability is not mine. As it stands I have requested on several occasions for a signed contract or documentation which would prove that I owed you this liability. My letters have been very clear and a request for validation has been made against your agency according to the FDCPA. Even with this continued communication, you have still failed to notify the credit bureaus that this item is in dispute. So that we can both be clear. Here is what you are violating: 1785.25(c) So long as the completeness or accuracy of any information on a specific transaction or experience furnished by any person to a consumer credit reporting agency is subject to a continuing dispute between the affected consumer and that person, the person may not furnish the information to any consumer credit reporting agency without also including a notice that the information is disputed by the consumer. I have disputed this alleged liability and requested documentation to support this appearing on my credit report. As of now, your company has not mark the account as being in dispute. Collection Agencies are required to mark the item in dispute. I have notarized copies of my Trans Union, Equifax, and Experian credit reports that not only are not marked as disputed, but are in fact marked verified. Confirmation of the above information can be attained from Robin Holland and Priscilla Williams of Equifax. What I am requesting is that all of my personal information in regards to this alleged liability be deleted from your systems and a Universal Data Form be faxed to me sent to Trans Union, Equifax, and Experian deleting this alleged tradeline. As of March 5, 2003, I have issued a complaint with the Better Business Bureau of Santa Clara County. As it stands, your company has over 66 complaints against it. If they now mark it in dispute, that leaves them the opening of a bona fide error defense, and could leave you with a bad TL, albeit in dispute.

Rewording it thereby cutting the word content can reduce the word content to about 260 words and thereby raising the Flesch level to about 11 which is quite a jump in readability and understandablilty. In the reduction process I note that you are repeating yourself a couple of times and I am not convinced that doing so helps much. Of course, as you say this is just a rough draft and rough drafts are usually a necessity for getting one's thoughts down. Good thing we have these computers so that we can revise and change so easily. Getting rid of excess wordage is greatly helpful in achieveing clarity and understandability. One thing I have noted over time is that the average newspaper or magazine article usually reveals that the author has approximately the intelligence level of a 4 year old. So even your rough draft is apparently better than that of your average reporter. (LOL)

If you have Microsoft Word you can take any letter, message or snippet thereof and do a copy & paste routine then run their spelling and grammar checker on it and it will help you to better your letters tremendously. If you do that you will see what I mean and over time it will help you greatly. Using it is not only helpful but fun and interesting as well.
