VERY NASTY letter from CA

    I got a validaion back today. Guess what it says....on a yellow lined pice of paper


    F*** OFF AND SEND US OUR MONEY.


    I could never prove they sent it to me, the envelope has their name right on it, they could just say they sent something else. Still, I must be getting to them aye...LOL

    If I were you I'd file suit tomorrow! Then I'd send them a copy of the lawsuit, demanding that they delete or else you'll see them in court.

    It's obvious this CA is totally unprofessional. I'd bet money that they will buckle under as soon as the see the lawsuit. They are too eager for the money, so eager, in fact, that they are willing to break the law.

    Try it. Play hard ball!

    WOW!!!!!!!!!!!!!!!!!!!! I am appauled and I agree with everyone else. Sue the Bastards. Who was this?

    Surely your significant other, neighbor, best friend or family member was there when you opened it and can testify (RIGHT) that was in the envelope. I would go file a lawsuit ASAP and have the person who saw it (YES SOMEONE DID) sign a notarized afidavit that they in fact were with you when you checked mail and saw it come out of that envelope. Sue their asses off!!

    I open the mail before anybody gets home (most days).

    If you SUSPECTED that they MIGHT send a bad note, you could have 3 neighbors and video tape the "OPENING"...

    They ASSUME you wouldn't have ANY witnesses...or waste your time filming.

    If you actually did get it on tape...they would be "DEAD MEAT".

    Really though- How would I prove that they sent this. That is my only problem with suing them.

    Ohno,

    Definitely hire an attorney. I sued a ca for "problems" during a phone call. There was no proof, only the people I had told about it.

    It was settled out of court. Their first offer was "we did not do this, but we wil give you xx$." LOL

    Go for it!!!!

    You may or may not have opened the envelope before anyone else was home. They will never be able to prove that you opened it alone. I'm assuming that you're either married or have someone who lives in the same home as you. Have an affidavit (example based on your situation shown below) signed and notorized, make a photocopy of the notorized affidavit (or get the Notary to notarize 2 identical copies of the affidavit) Send the copy return reciept to the collection agency with the following simple statement in your letter:

    By sending this offensive letter, you have violated my civil rights. I will be taking the notarized copy to the affidavit to the (COUNTY) courthouse in 1 month time filing suit against your company. If you wish to prevent this lawsuit from happening, here is what you must do.

    Then list out for them your demands. I would think something like . . . Remove the derogatory tradeline from ALL 3 of the CRA's . . . possibly throw in that the mental anguish caused by them would be helped with a $500 settlement.

    Affidavit

    The State of (STATE), County of (COUNTY)

    Before me, the undersigned authority, on this day personally appeared (YOU) and (WITNESS) known to me to be the testatrix and the witnesses, respectively. (YOU) in full view of (WITNESS) opened up a coorespondence from (MESSED UP CA) which contained only the piece of paper containing the words "F*** OFF AND SEND US OUR MONEY."

    Speaking of Allied Interstate, does anyone have a fax number for them in MN (their headquarters). They wont give it out over the phone.
