veterans please check this out?

    i sent debt validation to CA on 8/29/02 they called me on 9/12/02 i told them i didnt think they were supposed to contact me untill i recieved validation.
    she ask what address i had sent the letter to when i checked i had in fact left a digit out of the PO Box number. So on 9/13/02 i sent it out again after confirming the address i was supposed to mail the letter to with here by phone and on the billing address. (this address was in a differnt state as the address i used the first time) i got my green card back yesterday they recieved it on the 19th. today i got the following email
    (i did not include my email address in my letter)

    THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE
    USED FOR THAT PURPOSE"

    Thank you for contacting xxx. Please forward your correspondence to:

    XXXXXXXXXXXXXXX Inc.
    xxxxxxxxxx Parkway, Suite #xxxx
    Duluth, GA 30096

    Or you may call 1-800-xxx-xxxx

    Do not respond to this e-mail.



    is this a violation of section 809 ?
    i think it should be since it says this is an attempt to collect a debt and i have recieved no validation. what do you guys think?

    Collectors monitor this board. There was a thread about that a few weeks ago.

    They may have pieces together enough information about you from this board, and other boards you have posted on.

    Well, if they email me.... I'll never read it! I get so much junk email that I go down my inbox: "del, del, del, del, del, del......." I only skip on names of family and friends and CRAs.

    Great question.

    It's premised upon the fact that the line "This is an attempt to collect" is a collection attempt, in violation when in the face of a val. demand.

    The problem is another portion of the law REQUIRES them to include that line on ALL communications.

    So effectively saying that they violated the law by complying with the law will NOT work.

    Nice try tho.

    ( if you have an answer to what we discussed the other day i would prefer an email answer) please.


    would they not have been following the law by not contacting me at all. and forwarding it themselves since they did they have now broken the law?
    i sent the validation request to the address i was given on the phone. i dont have a recorder but i do have a copy of a letter they sent me with that address on it how was i to know of this other address?

    so do i need to send them another validation request to the new address i was just given or wait 30 days and see what happens?

    Isn't that just an odd one? First of all, I have to wonder why, if one sent a letter to a certain address, the CA would ask one to send it to a different address. Evidently, they don't have their act together. I also wonder if they're just trying to verify that it's You (this specific, alleged "debtor") that's posting on these boards - maybe they think they can prove that you knew about the debt by a certain date, etc. Nice try, monkey boys !!

    Who knows, maybe they're sending mail to every e-mail address they can find on these boards, trolling for debtors. Times must be getting tough.

    I would think that since the "debt collecting" statement is in the e-mail, it qualifies as collection activity, whether they're asking for money or not. They didn't address a specific remedy they're pursuing in the matter, which, I believe, is the only communication they're allowed to make during a validation period.

    i amybe wrong but it seems to me posting on here and discussing this matter or anyother would be just the same as talking about it with a few friends.

    what do you guys think?
