I'm just wondering what are the chances of having this happen?. I have 3 charge-offs, one of which I'm doing a payment plan with and they are cool. One charge-off is in the original amount of about 5 grand (from nextcard) plus the BS interest CA is charging. They are scumbags and I cant deal with them anymore. They screwed up a payment plan and then blamed it on me. Anyway Im sending out validation soon, but supposedely they are filing a lawsuit. I havent heard from them for about 5 months. The debt is about 2 years old and 4 years it will be past the SOL, but if they do happen to get it to court before that, what can be done to prevent wage garnishment?
I am new to creditnet myself, so I have no advice to give on this situation. However, please be patient. I have found this site and the members to be very helpful to all who are wanting to learn about credit repair. Sometimes it may take a while. Thanks.
Mecro, There was another thread that asked if a charged off debt can accrue interest. Logically, you would think that it couldn't. But I don't know the factual answer to that one. How did they mess up your payment plan and then blaim it on you? Do you have documentation that they screwed up the payment plan? I know that CA's do this intentionally because I just had one do this to me. Luckily, I am now dealing with the OC. Hey! Have you contacted the OC regarding the payment plan and presented your side? Did they violate any regulations? Maybe if you went over your paper work with a fine tooth comb, you could find some violations. They'll probably screw up with the validation anyway. That seems to be what happens with some people on this board. I'm a newbie and have limited information. Too bad there haven't been any replies to your dilemma. Good luck! Sirrowan
Well Mecro, if your state allows wage garnishments and/or has no exemptions for head of household status or, you don't qualify as a head of household then, you're screwed plain and simple. States do have limits on how much can be garnished per pay period. This may be time to reopen communications with the ca and see if something can be worked out.
Well I live on my own, not with parents or relatives, so I am the head of the household. Per New York state, 90% of my wages are exempt. Anyway nothing has happened yet, but I am trying to get info on how exactly wage garnishment would begin. If they even file before the SOL, what would I use in my defense to deter it.
