This is a mess so sorry for the mess. Have read so many posts that I have managed to confuse myself fully. Acct is a CC that is out of SOL. Originally a FirstUSA/Bank One account, charged off in 98 when Bank One took over FirstUSA and sold to Exterra who then sold it to Palisades. $6500 balance shown with interest fees and other assorted b/s. Disputed as not mine with Equifax and came back "verified" and rec'd a letter from Bank One with form letter asking me to fill it out if I feel there is an error, etc. Called OC (Bank One) to inquire about account and after much searching the lady says account is in system at my old address (from 7-8 years ago) but not much else other than who they sold it to. I only know that Palisades owns it because they are reporting to Experian. My problem is I want to get this off of Equifax. Once again, I disputed as "not mine" and was "verified". Do I attempt to validate with OC or wait until CA is unable to provide validation since they have to get this from the OC anyway or do I just send Equifax a procedural without waiting. I really don't think any of them can validate. Thanks
Did you send a validation request to Palisades yet? That might be the easiest way to go. If they can't verify then they have to delete the tradeline. In my opinion, since you've disputed twice with Equifax already, I'd leave them alone for a while... since you're not quite sure if they were actually able to validate... maybe they did. Palisades has a poor reputation. I know this only because they listed a bogus tradeline for me on all 3 CRAs... so I went searching the web for them, and found a lot of complaints about the same thing... bogus charges. My thinking for you then, is since they don't really seem to be on the up and up, they probably can't validate. I think it's LBrown on this board who says 95-99% if the time the CA can not validate. I would suggest going that route. I'm sure others have suggestions too, and I'm new to the board too, but I hope this helps you! NuB (by the way, Palisades has been deleted from my CR's!)
Yeah I sent out validation end of last month. Got a letter from Palisades requesting more info because "we are unable to locate the account with the information provided. We respectfully request that you provide us with you SSN and/or you account number." They must not have even looked at the damn letter because both were on there. Sounds like maybe they are as dumb as I have been reading on the message boards. Needless to say the clock is ticking and I have no intention of replying or acknowledging this letter. The clock is ticking for them and it seems obvious they can't validate. BUT, the problem is, if they can't validate as I suspect, can I use that to squeeze Equifax for deletion. I don't know what to do because the CA (Palisades) is reporting to TU not Equifax. Only the OC is reporting to Equifax. Since the CA has to go through the OC to get proper validation, can't I use that as leverage. Please tell me what you think.
Okay, let's see if I can help you at all, with what I've learned here. I don't believe you can use the CA as leverage with Equifax. If this debt is past SOL, how close are you to the 7 year mark? Maybe this account is obsolete, and then they would have to delete it. Are there any mistakes at all in the Equifax tradeline? If there are, then your next letter should be a proceedures request to Equifax. When your 30 days are up after sending your validation letter to Palisades, then you send your validation2 letter, then your ITS if they haven't deleted your Experian TL by then. You're going to have to deal with Palisades/Experian and BankOne/Equifax seperately.....as far as I know. Hope this helps a little. NuB

Re: Re: Wait for CA or go to the OC Hmmm ... you say that you sent them a request for debt validation including all info they would need. You say they wrote you that they cannot locate the account. Looks to me as an evidence of not validating. I would send copies of both letters to the CRA with a request for deletion. JMHO
