I have read in interest of experiences with Washington Mutual by some of the other members of this board. I hope you might give me some advice on how to deal with them. Mortgage was sold to HomeSide Lending some time ago - HomeSide Lending was purchased by WaMuBk. Current with no lates ever when filed BK-7. After filing I received a letter from HomeSide Lending instructing that "until the completion of the bankruptcy all payments be mailed to: Attn: Cashiering....... San Antonio,TX. .......... If you have any questions, please call us at 1-800-638-5647. Bankruptcy Department." At the bottom of the letter was an address in Jacksonville, FL and the 800# was posted again. This piqued my interest, so I called the number and a recorded message informed me that I had reached a "Debt Collector" and that all calls would be recorded. A "Servicing Agent" then came on the phone and offered to set up a "Quick Collect" through Western Union. Of course I declined and asked how the payment process worked through the bankruptcy. The "Agent" told me to notify them of any changes; such as address, etc. and to call them when the BK was discharged. I had this sinking feeling that I was NOT talking to someone at WaMU so I asked her what company and location this 800# had reached. She replied, "LOGS Financial". I asked her specifically the full name of the company and what business they were in. LOGS turns out to stand for Law Office of Gerald Shapiro (therefore the message of "debt collector". I reminded her that I had never been late with a payment and had continued to make payments on time after filing BK, and asked if LOGS Financial would appear on my credit report. She assured me that their name would NOT show up on my credit report. Our BK-7 was discharged in May. I mailed the June payment and coupon early to WaMu at the original payment address. The next day I called LOGS to let them know of the discharge. This time the recorded message identified them as "Default Servicing"! They told me that they hadn't been informed of the discharge, and that all payments must go through them until they do. I replied that WaMu was the creditor on my list and they would have received the notice in the mail a couple of weeks ago. LOGS said it could be several weeks before the notice was forwarded on to them. Then they asked me to fax them a copy of my discharge papers to notify them of the discharge. Now my question for you valued "old timers" on the CreditNet board: Should I fax them a copy of the discharge??? I have scoured the messages on the board and know enough NOT to fax it to any creditor and VERIFY that I actually did file BK. But reasoning through the situation, I realized that the discharge was mailed to all creditors on our list of creditors, so WaMu would have it and it would seem that they would forward a copy on to LOGS anyway. I have worked very hard to protect my credit score and report as much as is possible when filing BK and have corrected several errors already. I don't want to face the nightmare of trying to have something deleted months from now, only to find that I VERIFIED the BK for the creditor, or in this case, the Debt Collector! Anyone have any ideas on the BEST way to handle this situation??? I don't want LOGS to appear on my CR showing late payments or as a collection on top of the BK. The way I see it: You want LOGS out of your life. You never really wanted them IN your life. The reason WaMu did this was because of the Automatic Stay - so that their attorney would know immediately if youmiss a payment and could quickly petition the Bankruptcy Court for relief from the Automatic Stay and get he OK to foreclose. So... LOGS will get the dischage anyway, and giving it to them will get them out of your life faster, what do you have to lose by giving it to them? They are not on your CRA file and will not be. BTW, when I call my mortgage bank, even if it's to ask for a copy of a tax bill, I get the mini-miranda. it's a legal thing, so don't think anything of it unless it's from a CA pursuing you.
Thanks Flyingifr. I don't THINK I have anything to loose by faxing discharge to LOGS - I just want to KNOW that they won't show up on my credit report as collecting for WaMu!!! Your input is appreciated and valued very much. BKinUT - - - - bumpity - - - - Anyone else here deal with a situation like this before???
