Washington Mutual (Herein after "WaMu") almost foreclosed on me 1 year ago this week. Yes, I was late mulitple times, but managed to cure the default and avoid the big ol' FC. They did nasty things to my TL's via all three CRA's. The kicker: they ended up spanking me with one or two 120's because during the ruckus, they lost my checks, which I can back up. VA helped me out and sent me confirmation of this fact today by way of call notes from the VA rep to WaMu's foreclosure department. I can even go deep with paperwork, I'm sure. Bottom line: WaMu realized they goofed big time and told VA Rep they would fix my credit, cause they had report multiple, evil lates (inc. 120day'ers as I mentioned). They never did. GASP! Question is: Do I go nutcase to get all lates around that period removed? Can I include intent to sue right of the bat because "I found that you had never corrected the lates, so I lost credit, refinance opportunities, et al." I want to be careful here. Mortgage companies tend to be better organized than your Average Joe OC. Validation would be stupid, because that's not what I'm after. I'm after ACCURATE and CORRECT TL reporting. Sounds like a violation of the FCRA, don't it?
Our loan was sold to them---needless to say inaccurate ( which they admitted) lates were put on our report. After almost a year dealing with inept CSR's we planetfeedbacked them. I don't think that helped-- except we got the CEO's name from there and mailed our letter directly to him. My husband said we would have to take legal action if it wasn't taken care of in 15 days. We got a letter saying it would be taken care of in 3-5 days. It took a little longer but it finally was taken care of. One thing you want to be careful of is if you dispute the late with TU and Wamu doesn't respond they delete the whole account. What a nightmare it was getting it put back on
You aren't having a good day are you? I would suggest (mainly because it has taken me several times to get it straight in my head), reading Sec. 623 of the FCRA. All the while, remembering, an individual does NOT have a cause of action under 623(a), only 623(b). That being said, I would dispute the TL's with the CRAs as never late first. See if that encourages them to correct it the easy way.

One of the OP's said they got it from www.planetfeedback.com . You may have to "write" the letter first (I can't remember), and once you get to the page where you can review and edit, I believe the address will appear.
My brother had a loan with WaMu. They reported him late multiple times and he was late. I simply disputed the late payments as never late. WaMu never responded to any of the CRA's. All late payments removed.
