I am familiar with the www.washingtonmutualsucks.com website, but am seeking additional information. Apparently anytime any WAMU mortgage holder files a Ch. 13, WAMU ceases to send the usual monthly statements including loans that carry an adjustable rate. This leaves borrowers to guess what monthly amount to pay and when. Now....after several rounds and threats of forclosure cancelled only 30 minutes before sale by a forbearance agreement, WAMU has not complied with the forbearance agreement....they received all specified payments in cashiers checks...they have never cashed (presented for payment) these checks and are now threatening forclosure again by refusing a work out agreement stating I was "non compliant with [my] divorce decree" and failed to make these payments. Along the way, I also acquired 3 differing payment histories that cannot be mathematically explained, 2 payment coupons stating next monthly payment was due a year or so prior to the issuance of the coupon for approximately $20,000, and 2 annual statements indicating my total loan balance was approx. $60,000 LESS than the forclosure notice. I have stacks of phone logs and correspondence. I have had a few scattered form replies that do not address the issues at hand. Any help would be appreciated....

If your mtg is included in your BK13 you need to talk to your BK attorney. If not you need a darn good consumer attorney. Looks like your gonna have to sue them.

I had something similar, but it was my ex-wife who filed BK7. Her name was still on the house mortgage. I was living there and trying to sell it, but still making mortgage payments. She was also still on my car, though it had been given to me in the divorce. Your BK attorney needs to unravel this for you.
