An insurance company claimed my car was involved in an accident, sideswiped their insured and left. This never happened; my car is old and has lots of scratches, body damage. A body shop employee said there is nothing on it that would cause 5000 worth of damage. They paid 5000 for repairs and 5000 for rental. I called them and said not to call unless they have a police report. I ignored their calls/letters since. The other day I got a collection letter for 10000. They want me send them the name of my insurance co or they'll consider me responsible. There was no judgment, lawsuit, etc. Any thoughts?
Contact YOUR insurance company and tell them what is going on. Whatever is happening to innocent until proven guilty?

Where's the police report identifying your vehicle as being involved in a "hit and run" accident? ? The record of your conviction for leaving the scene of an accident? What evidence do that have that makes them believe it was your car? I'd write a strongly worded cease and desist letter stating that they may only contact you with the answers to these questions and that you will get your insurance company involved only when they provide you with information that suggests that you are somehow responsible. I personally wouldn't get my insurance company involved unless things got out of hand - even if it is found to be a baseless claim, someway, somehow it might show up in a database and used against you years later.

Don't give out your insurance info! 6*How do you know they don't have a default judgment?
it reminds me of my car loan bank. they say they have confirmed proof that i have had a lapse in coverage. i did change to progressive but put them on as the lien holder/payee. im gonna have fun when i go in there in an hour to have them show me their proof. they didnt contact me so how is it confirmed? they need to get wired into the system.
I also thought I'd rather not involve my company. The only thing that's scaring me is that if I eventually have to do it for some reason, they might say I should have contacted them before and they are not responsible. The insurance company of the claimant paid it to him. The collection letter is from CA (it also asks for name of my insur. co). Previously the insurance co, Safeco, has been sending letters and calling. It's been about 7 months or so. I don't know that they don't have a default judgement (how does that work?). I think there was no police report made as I was never contacted by police and I asked Safeco not to contact me without a police report. Someone thought that they paid under an uninsured motorist clause and they need to have a name to attach. Someone else thought that sometimes people without comp/collision will have their cars fixed by making a claim and picking a car that has visible damage on it.

thanks for responding. 1. I was afraid they could say something like: "look there are all these scratches on your car; that's proof of the accident". 2. The idea was if 5000 worth of damage was caused, then there should be some corresponding damage on my car, no? 3. Safeco paid it to their insured. 4. CA 6. I don't. How would I find out
at this point i would do four things: 1) call a lawyer 2) inform your insurance of this fraud - because if the collection agency finds out, they can notify your insurance for you. besides your not claiming anything. they are trying to commit fraud. 3) tell them to prove it. trust me, there are experts that can determine if your car did the damage or not. 4) see if you can file some sort of police report for their extortion and fraud. you've let it sit too long.

Not pointing the finger. just making sure you didnt nudge em in a parking lot. or tap em at a stop sign. If you did fess up to it we all have accidents. if your sure its not, file a police report for extortion/ Insurance Fraud against the CA it wil shut em up in a hurry.

I know WE dont have proof, but you never know what someone walking to/from their car may have seen, or a camera at a drive thru restaraunt may have seen. Im just saying that the word alleged is thrown around a lot when it comes to credit, I have seen a lot of " I dont recall having XYZ acct." However when talking about ruining someone elses property eg: smashing a car. When I hear " I dont recall being in a little fender bender" that 99% of the time means that they were. just my 0.2 cents. I advise the poster also find out who notified their insurance company that he hit their car, and also did he loan his car out at any time.

They'll help defend you if you're sued, and they have investigators that can help determine if it's fraud. They have access to a lot of other information and if it's some kind of ongoing fraud, they may be able to help get it stopped and prosecuted. I am insured with USAA, and about a year ago they had an article in their magazine about some of the frauds that had been pulled or attempted and how they helped track the people down. And someone was right when they said that if you wait too long, they may not help you. If you have notified your insurance company, and then you are sued, they have an obligation to defend you. They also have an obligation to pay any judgment, up to the limits of your policy, AS LONG AS YOU HAVE NOTIFIED THEM AND GIVEN THEM THE OPTION TO DEFEND OR SETTLE.

If you read most rental contracts, it says that if you have an accident and have declined their insurance, you are liable for the cost of repairs and also for their loss of use. I'm sure they make that loss of use a very high number.

It's for their "loss of use" of the car. ..
