Weird auto insurance collection

    1* Umpteen pages of advice to a guy who obviously does not have auto insurance.
    3* What insurance company would insure a car in the condition the poster described?
    5*Let's say for argument's sake that he does have insurance.
    7*So now 7 or 8 months has gone by and the guy finally decides to inform his insurance company of the $10,000 claim.
    9*Hahahaha! I wish I could be a fly on the wall at the insurance co when that call comes in.

    3* The mandatory auto insurance laws do not exempt cars in bad or poor condition from the requirements of the law.
    5* BTW he does have insurance.

    NOW THAT WE'VE RESOLVED THE INSURANCE MATTER LETS MOVE ON TO THE REAL ISSUE - THAT BEING THEY ARE TRYING TO DEFRAUD FEDS AND OR HIS INSURANCE Co_OUT OF $10,000.oo ON A BOGUS STAGED ACCIDENT IN WHICH NEITHER FEDS OR HIS CAR WAS EVER INVOLVED.

    I would be filing suit on both SAFECO and their insured for damages and I would also file criminal charges against both of them.

    Oh yeah that's right-i forgot Insurance fraud and staged accidents are legal.

    I didn't say they were legal. You turn it over to the insurance company and they determine what action to take.

    Ok then feds insurance co. could file fraud charges rite.?
    Also safeco could file fraud charges against their insured if was fraud correct?

    They could take their evidence to a prosecutor to see if there is sufficient evidence to file criminal charges. There is a pretty stiff burden of proof on the criminal side.

    But that's why it's important to report it RIGHT AWAY. While the insurance company might not take this case to the prosecutor, they may be building more evidence of a series of actions. That's where they really want to expend their energy--to find the people who repeatedly defraud the companies. But prompt reporting and investigation is essential, so I suspect in this case nothing will happen. The trail of evidence is too cold. Accusations and "he said, she said" won't cut it in a criminal court. Too much time has elapsed now.

    I do still. No contact from 2nd CA after I sent C&D letter. An attorney I contacted felt it was not worth suing the first CA due to the subrogation thing.
    The 2nd CA presents itself as aggressively using attorneys, etc. Assuming SOL is 2 years in CA, that leaves them 7 monhts since incident approx.

    Who does a hit and run causing 5 grand worth of damage and doesn't get cited or even arrested for it?

    Do you have any other vehicles registered in your name you may not be aware of? If you sold a vehicle, did you remove the plate and turn it in to the DMV to get a release of your liability? Not sure how it works in your state, but you have to take care of these things yourself in La.

    How else could your name be tied to a hit and run unless a license plate number was obtained and they ran a report on it?

    This all sounds pretty strange. I'd get a lawyer before I volunteered info to anyone.

    Just because it's 4 years old, and was probably resolved at the time, does not mean it can't return from the dead.
