Weird auto insurance collection

    most rental contracts,
    ***it says that if you have an accident and have declined their insurance, you are liable for the cost of repairs and also for their loss of use.

    fds didn't rent the car. The rental company claims his car was involved and that he caused the accident and is therefore responsible. The responsible person would be responsible to pay the rental company for repairs and loss of use. I just pointed out that it was on the rental agreement to show how they get the rental amount. If you rented the car and caused the accident, you would be responsible for damages and loss of use. If someone else caused the accident, they are responsible for the same thing.

    The important thing here is for FDS to report the claim to his liability carrier, then sleep soundly at night knowing they will take care of everything. That's the service he paid for.

    Right but the rental car wasn't the car involved in the accident as I read it.

    i'm lost.

    i'm reading it that the OP is being sued for damages and the cost of the other party having to rent a car.

    where did this damage to the rental car come from?

    My concerns here (going back to the first post in the thread) are:

    1: If the poster had no knowledge of the "accident" then how did the other party find out about him? Make up a license plate number at random?

    2: The OP states that he has no damage to his vehicle that matches the car he allegedly "hit". If that is the case then it sounds like an extortion scheme.

    3: The way Auto insurers are, even if the poster is absolutely innocent, his rights are subrogated to the Insurance Company's as soon as he notifies them of a potential claim. It's the Insurance Company's decision to settle or not - not the poster's. Nevertheless, it is probably the OP's insurance RATES that will go up because of this.

    4: If the poster IS at fault (did hit the other car) then the time frame between the actual incident and notifying his Insurance Company is so long the Insurance Company will probably disavow any liability.

    5: If the other party is alleging a hit-and-run, which is a crime in every state, where are the police and why are they not involved?

    Sorry, I misread something and thought that the insured was driving a rental car. At any rate, my advice to get the OP's insurance company involved NOW still stands. They will take care of whatever needs to be done. As someone mentioned, that's what you're paying for.

    It will only raise your rates if you're determined to be at fault by the insurance company.

    Your insurance company "MAY" decide to settle...SO BE CAREFUL!!!!

    They can GO AGAINST YOU and bill you for $10,000

    Have a BODY SHOP put in writing that to the best of their knowledge...THIS CAR WAS NOT INVOLVED IN ANY SIDE-SWIPE ACCIDENT...

    THEY ARE SUPPOSED TO BE ON "YOUR SIDE" BUT NOT ALWAYS...

    This is why I am hesitant to tell my insurance co.
    On the other hand I am afraid the delay will cause them to say we are not responsible, etc.

    I like the fraud dept idea or I guess I could call the dept of insurance.

    I am stuck

    1 their insured apparently reported the license plate

    2 the car does have lots of body damage, horizontal scratches all over the place on both sides. All of these were there before the stated timeframe

    4 Does Safeco have to prove that they contacted me and how would they do that. I did call them once (no message about recording calls)

    5 they called it a hit and run but never mentioned a police report or anything else just very vague "we have reason to believe" type things which I hear are typicall for insurance companies. In addition the collection route is weird vs. lawsuit, etc.

    2*So do you have the only car with body damage? Hardly
    Could be that they are making a bogus claim against you and several owners of cars with body damage.

    1*Was this 5000 to repair the insureds own personal car and 5000 to reimburse the insureds cost to rent a replacement vehicle while his car was in the shop being repaired?

    Was the insured driving a rental and the insurance paid 5000 to repair the rental car and paid them another 5000 for loss of service while the rental unit was being fixed?

    My guess is that after the accident, which like most accidents, happened pretty quickly and shocked the other driver so much that he/she wasn't paying attention, that the other driver looked around the nearest parking lots and found the OP's car, and by the looks of it all scratched and bashed up, assumed that it was the car that hit him/her and reported it's license number to his/her insurance company. Definitly contact your insurance company and file a fraud report. Also consider filing fraud charges with the police including the statement from the body shop stating that your car doesn't have damage indicative of causing the damage to the other car.

    This would explain why no police report.Why would you want them around they might discover the facts and catch you up in your little game of fraud.!
