Weird auto insurance collection

    When you contact your carrier, you can certainly use as an excuse for your apparent tardiness that "I did not previously provide notice of this alleged occurrence because I know that no such occurrence happened, however, the claimant's insurance company has continued to contact me and has ignored instructions to cease doing so. I was unsure how to handle the situation, but I have since learned that I should forward this claim to you."

    Is there some specific rule about the exact time period the carrier has to be notified. I am in California. This occurred in March. First letters came in in May I think.

    If I am asked when exactly I found out should I avoid the answer or does it not matter.

    Should I switch insurers before notifying my current one. Is it typical for them to cancel policies if they are not notified.

    Just tell the truth. It may not help, but there's no use in a lie that gets uncovered down the road.

    No telling what they'll do. I'd switch first. Probably find a better rate somewhere.

    The way it works, you can get $1,000 for each different violation. Therefor even thou they sent 5 letters, it's still only worth $1,000. Search for any other violations, have they put anything on your credit report yet? If so, did they put it on your credit report between the time you'd asked for validation and now? That would be another $1,000 violation. Did they do an inquiry on your credit report? That could be another $1,000 non PP violation. Then there might be punitive damages, so if you do file suit, you should find enough to fill it up to the maximum allowed in your county for small claims court.

    The question of if they are within their rights to continue trying to collect because they claim to not be a "collection" agency are confusing thou.

    suspension for lack of insurance which is mandatory. I guess they think I am not insured or just trying to make their letter more scary.

    It will only raise your rates if you're determined to be at fault by the insurance Co.

    Questions!
    1*Since fds didn't do this where is the car and driver that did hit the guys car.
    2*Why did the guy report fds plate instead of the plate that hit their car?
    3*Since safeco and the claimant have feds plate why didn't they report the alleged hit skip to the police?
    4*If they did report it to the police why haven't the police questioned fds about it?

    the DMV would send me a form in the mail that i had to send back proving i had insurance.
    And if i didnt prove i was insured on the date they sent the form, the state of Ohio automatically revokes my liscense

    My insurance co provides me with proof of insurance cards with my policy.
    Why couldn't fds head safeco off at the pass by sending the DMV a copy of his proof of insurance card?
    That way if he gets reported for no insurance the DMV already has proof that fds is insured.

    I would not advise doing this, simply because if a Police Report has not been filed and they have not asked for proof, they will just disregard his proof of insurance. The proof has to be returned with the form. And if it was on private propertt, a citation cannot be issued. Only a police report can be made stating the facts, date, time, cars involved, etc. etc. I would do as Hedwig advised and notify the insurance company as soon as possible. Let them handle the allegations. If they feel the need they will notify the BMV.

    Possible answers to your questions llbrown.

    Q:Where are the car and driver that did
    A: The same place that all my tax dollars are,only god knows.. Im not a prophet.

    Q: Why did the guy report FDS plate,
    A: well maybe it was in the lot, maybe he cruised the streets looking for a car banged up to blame an uninsured motorists claim on, maybe he's lawsuit happy, maybe FDS loaned his car out and forgot that he loaned it out, the person driving got into an accident and left, and didnt tell anyone. Maybe he accidentally hit someone ina parking lot and his plate was recorded, or maybe he's guilty. Only god knows this one too.

    Q: Why wasnt the hit skip reported to the police.
    A : A false police report is a misdemeanor 1, you will do some jail time, even if its a few days. If they are lying and putting the squeeze on him, better they not file a report and see if the insurance company will fold and pay the claim.

    Q: Why have the police not contacted him.
    A: Its private property eg: shopping plaza, mall parking lot etc. if a citation was not issued a police report only documents time/date/occurence, and highlights the damage for civil liability.

    If FDS has an insurance agent, he might try calling the agent first. Play dumb. Just say, "these people have been bugging me, saying I had an accident, and I haven't. Can you help me?"

    As far as getting a card from your insurer, or sending a copy of it to the DMV or whatever you call it in your state, even the card isn't definitive. It shows you had coverage when the card was issued. It doesn't show if you have canceled insurance in the meantime.

    Most states require the insurance company to notify them when coverage is canceled on a car. They do this exactly because of the way you're thinking. Many years ago, all cars in the state of Maryland had plates expire on a certain date. You had to have proof of insurance to renew tags. So, people would apply and get the temporary binder, use the number, and never pay for the policy. Or pay one payment and then not pay and get canceled for non payment. But they still had a card that says they have insurance.

    Now many states make the company report to the DMV when coverage is canceled, by car. If you don't turn your tags in or transfer them to another car within a certain period, expect to hear from the DMV. And, as sahlegian said, there will be a form to return, that is what they will work from.

    In Florida, there was a time (not sure if they still do it), where they put a bounty on your plate if your insurance was canceled, and repo men could drive around and look for plates to take off cars.

    If I hit skipped your car with my car plate 1010 why would you report FDS car plate 2020 as hitting you?

    My guess would be because there was no car plate 1010 either or any other car or plate for that matter!

    Seems to me the guy wrecked his own car in a single car accident & is trying to pin it on someone else.
