Weird auto insurance collection

    Not necessarily. It just means that if his insurance has been canceled, the MVA hasn't been notified yet or he fell through the cracks and won't be notified for a while.

    The only way for him to know for sure that he has coverage is to contact his insurance company. They are the only ones who can PROVE he has coverage.

    1*First of all, lb, it doesn't matter if your car is on the road or if you're driving it. If you have TAGS on your car, you must have liability insurance.
    2*As for people driving without insurance, if they are stopped and asked for proof of insurance or are involved in an accident and don't have insurance,
    they will most likely have severe consequences ranging from having to file financial responsibility (this is more than an insurance card) up to and including losing their license.

    1*A car that's not out on the road isn't going to be involved in an accident so it does matter greatly wither it's on the road or not.
    Also placing insurance on a car won't prevent an accident but not putting the car on the road will so why have insurance on a parked car?
    Like I said this is one of the problems with FR.
    2*This is where the enforcement should be - not on the non driven or unused car.

    No change in my insurance status.

    After receiving the body shop documents I wrote back and asked for evidence involving MY vehicle. They sent the same bodyshop docs once more.

    Did not hear from anyone like FTC or dept of insurance regarding my complaints.

    When I first talked to claimant's IC (ins co), I told them the car was not involved and not to call any more without a police report. The guy said OK, but I can't guarantee they won't call... hit and run... blah blah..

    I read recently on a california site that a hit and run has to be reported to police within 24 hours.

    It's interesting also how claimants IC just took his word when people get license plates wrong all the time when they call the cops (this is according to someone who takes these calls).

    1*Don't think it makes any difference in this case: SAFECO can still collect report or not!
    2*This would not apply in your case if the police were never called.

    To close this out: If FDS isn't going to report the "non-incident" to his current carrier, he should understand that if and when he is sued by the other side, he must run not walk to that carrier with the suit papers and demand that they defend him.

    They won't be too happy about it, but he does have an argument that his good-faith belief nothing happened provides some justification for his refusal to get them involved earlier.

    I don't believe SAFECO is going to forget the $10,000.oo.So I'd say it's more a matter of when rather than if.

    still a lively thread huh... Im for once at a loss, I can offer no further words of either condolence or advice, Im tapped outta info and tired. I hope whoever is driving with or without FR doesnt hit anyone for real.

    The OP has kind of been waving a red cape at them for a while. The bull has yet to charge, making one doubt the courage of the bull.

    My guess is they know they have an extremely weak case, and that their potential defendant doesn't seem like the type to roll over easily.

    Still FDS shouldn't be surprised when he gets the summons to appear in court.

    1*I don't think they were called here so the cops weren't given any plate number.
    It was SAFECO who just took the claimants word about the plate No. not the police.
    2*Who are you talking about taking such calls here? Is it a Police department or is it an insurance company?

    I am not necessarily saying it applies to my case or doesn't, just that it's another weirdness that's occurring here: insurance co that just takes someone's word about a license plate, does not ask him to file a police report, etc. Being in that business they should know that reports of license plate numbers are often wrong as I learned from someone who does that job in a police station. I am not saying that anyone called the cops because they did not. Why not ivestigate before paying out 10000.


    Here is some more info to complicate the situation. My car was rear-ended while legally parked about 6 months after the alleged accident discussed here. It's a little strange because it's fairly minor body damage. The responsible party's insurance co wants to total the car and is about to send an offer.

    Get an estimate for repair on your own...

    They CAN'T total it unless it is like over 75% of the value of the car (or something like that)

    Not an insurance expert...

    You can always REFUSE their offer...
