weird situation

    I'm gonna send Butch's sub. CA letter to NCO collecting on a charged off CCB account. IT IS within the SOL. Simm Associates got the account first, sent me letters, and threats of asset investigations, and after I requested validation on it, Simm continued to call after receiving val. letter. Next thing I know, NCO has pulled 2 hards on my CR. , then I get the letter collecting for CCB. Did they have pp (since they didn't know about Simm, I guess) and can I demand removal of inq. since Simm didn't validate? The collection letter states account with CCB, doesn't say anything about Simm Associates. Hope this makes sense!!

    Great question Patty! Wish I knew the answer LOL.

    Why wouldn't it hurt to include that in the letter as well?

    thanks, jlynn:) which brings up another question!! In the opening of the letter, it says...so and so has sold/assigned you...do I put CCB, or Simm Associates? see what I mean? The NCO letter says nothing about simm, but they obviously sent the account back to CCB without validating!! I'm SO CONFUSED!!!

    I think I would assume its the OC. Remember, the premise is to also let the OC know that they are on notice of the CA's violations, and you *might* hold them accountable.

    Been thinking about the PP. Depending how this plays out, they might have a bona fide error defense, especially considering the way Butch's letter is written.

    right about the CCb at the beginning..in the body of the letter, I will put where the continued collection of the debt was frozen by the demand for validation from Simm. I would just like to get those 2 hards off!!

    Well, if NCO stays true to form, they eventually violate the FDCPA or FCRA. So save that as part of a settlement agreement!

    update and help needed!! I guess after my subsequent CA letter to NCO, they decided to let CCB deal with it. I received a letter from CCB today with a Fraud affidavit attached. What do I do now? I never said it wasn't mine, I just wanted them to prove their right to collect it!!

    BTW, just read foolsmates post about OC switching CA's after val. request....does this mean if I don't answer the CCB paperwork for fraud, that they will just let NCO continue to collect?

    Are you sure NCO gave it back to CCB. BTY who is CCB?

    lb, CCB is cross country bank, and nco was never on my reports....not yet, anyway
