Hey everyone .. update on my judgment .. i went to court today to have it vacated and the other side, CA, did show up and they agreed without any discussion to grant the wish to vacate the judgment .. he was actually really cool about it .... so now i have my certified, sealed court papers saying the judgment has been vacated and the matter settled and dismissed ... yahoo so now, do i just send a copy of this and a letter to the CRAs and ask them to delete TL? thanks tboy
Burtch, yes --- and it came back as verified and updated --- they changed it to "satisfied" ... this was a valid debt, but i never recieved the summons so i had no idea there was an actual judgment against me until i saw my credit report. i moved and they sent the summons to the wrong address. they found me a few months later and browbeated and yelled about garnishing my wages -- but even then, i never was fully told they actually had gone to court and received a summary judgment (since i obviously didn't show up). i finally got a partner on the phone, who didn't yell and was much nicer. i told him i hadn't recioeved any letters from them and that i had moved and he agreed to set up a payment plan, which we did and i paid off in 2001. so i went to court today to have the judgment removed since i was never properly summonsed and they never actually garnished my wages. the CA attny showed up and agreed to my motion to vacate. tboy
If you no show some of the Judges in my office, the next time you do show up, good luck getting their attention. Some feel if they have to be there, and the plantiff has to be there, you better show your face.
Re: Re: Went to court today Some feel if they have to be there, and the plantiff has to be there, you better show your face. 420greg ============ How do you do that when you never knew anything about it???????????????????? ?????????????????????????????? ????????????????????????????????????????
Re: Re: Went to court today lbrown: they were referring to the CA's attorney; if they ever need to bring a case before the same judge, and they wouldn't have shown up, they may have problems getting the same judge to take them seriously in the future if they need to bring a case before them for their clients.
Re: Re: Went to court today LOL .... well you want to hear something sad and i think disguting. there was about 5 pages full of cases on the docket for this judge (in small print). the majority of the cases were hospitals suing people -- and the same hospital -- GW -- (which is the hospital that got the judgment against me -- sued me over $800). There were 2 other loacal hospitals thrown in the mix. then of course some credit card companies, local utilities. but majority was medical. the people who showed up were obviously impoverished people, many were elderly and struggling to move. others were very young and pregnant. (this was DC small claims) anyway the attny who worked with me was there for the other pages and pages of cases that lawfirm/agency was litigating for the hospital that sued me. GW, itself, is in trouble right now though for racial profiling. i have a friend who had clinicals at the ER there a few months ago. she's seen them do things like downgrade patients symptoms with referrals from clinics if the patient doesn't have insurance. one patient they downgraded his "heart attack" referall down to a "persistent headache" ... he'd been having a heart attack for 4 hours before someone took care of him. and right now credit card lobbyists are trying to get congress to make it so that it's much more difficulyt to file for BK. they claim that the majority of BKs are by people who are irresponsible and who buy up a lot of luxury items that they can never pay for. a study just released a few months ago though showed that more than half of all BKs are filed due to overwhelming medical bills -- even by people who have insurance but who are under insured. sorry for the rant. i was glad my judgment was removed but extremly disgusted by watching big business hospitals railroad more poor people. when are people in this country going to wake up? tboy
Re: Re: Re: Re: Went to court today ... And realize that a vast amount of people in this country are suffering and can not afford proper medical care because health care is a business in this country. I run in activist circles -- I know many people know, but an overwhelming number of people do not know -- and/or do not care. tboy
