I co-signed for my son for graduate school housing. He left school in Dec. owing what the school claims is $900. I have not seen an invoice yet. I had been waiting for the school to contact me with a bill. Friday a CA contacted me, and started threating that I had to pay now or they would turn it over to the CB's. I said mail me the information, and I would get back with them. They said they couldn't mail it, it would take to long, and they would call back tuesday for me to find a fax numbe to send the info. to. I will pay it but would like to know my rights as to what they have to do before turning it in to the CB. Since they started out so rude, and demanding, I would like to make them go through the proper steps in collection, but don't want to take to take a chance of being turned in as a collection. Suggestions would be appreciated. jay
Don't pay a bill that they CAN'T and WON'T PROVE... If they PROVE it...then pay it... US MAIL still takes only one week max. COAST TO COAST last time I sent something CA to ME (one week is too long???)...3-4 days most of the time...
Bayou, get a fax number for them. If you post the CA's name and number, we can help you find it. Fax them validation, and pull your 3 reports same day. The validation should stop them in their tracks from posting to the credit bureau, and if they do, the 3 reports will be proof that the TL's were not on there when they received the validation. They now have 5 days from the date they called you to send you something in writing, if they don't - violation. Read Sec. 809 of the FDCPA. Sounds like these goofballs are one step away from a violation = $1000 - 900 dorm fees = $100 in your pocket! I've noticed lately, I have had some changes to mine this month, status dated back to last month. Thats why I suggest pulling your reports today.
