What are my rights?

    I have student loans that have been in an in-school deferment status for a while. Last semester I had to drop out of classes because of a family emergency where my son was hospitalized. Upon withdrawing from classes, my school notified Citibank that I had withdrawn from school. The following semester, I went back to school.

    Yesterday I ordered a copy of my credit report and it shows that Citibank is reporting that I was 30 days late on my student loan payments.

    1. I was never notified by Citibank that I had a payment due. ( I have a letter that says my loans are on deferment until 12/2004)
    2. I never received a phone call or a letter or statement that said I was late.

    I called Citibank and they refuse to change anything on my credit report. They told me over the phone that statements are a courtesy and that they are not required to send them out.

    Do I have any rights at all or am I completely at fault?

    I recently went through the same situation - withdrawing from classes, but I received a notice that my first payment date had changed.

    They never sent you anything saying that they had been notified by the school that your enrollment had dropped below half-time and therefore your payment date had changed?


    When you re-enrolled, did you fill out any forms saying that you were attending at least half-time and have it signed by admissions and records?

    I believe that's what they require in order to keep the loan in deferred status. Still doesn't change the fact that they should have sent you a notice telling you that your deferment period would be ending sooner than originally expected.
