I just got off the phone with a with the collection manager of one of my CA's. Brian is an a**! He told me that all he would do is report my account as paid. I then asked why we couldn't come to a resalution to have the account deleted and was laughed at and told that it is "highly illegal". I then told him that it was not and asked him to show me the law that states what he is claiming. I was then told "I'm not going to argue about this. I'm not in the mood! Are you going to pay or not?" I tried to stay calm and explain to him that I am not trying to get out of anything only trying to meet on a common ground. He then said that he has things to do, If I want to pay the account to walk down and pay and he would report as paid. I then asked why he was so unwilling to work with me and all I got was more attitude. I told him being a manager he should really try to calm down and work on his customer service skills. He said he doesn't need to sit there and take my abuse. What abuse? He then had to rudely terminate the call after I told him he has nothing to back up his arguements. What should be my next step? Should I try to get another manager? I don't have the patience to deal with this punk again. I'm so worked up right now that if I didn't live over 2500 miles away I probably would go down there. How old is this debt? Do you know it to be yours? Have they validated, if not? I don't like talking to collectors on the phone, and do any correspondence by letter, certified return receipt. And require that they do as well.

If you feel you absolutely must pay the debt, pay it to the original creditor. Not to a bottom-of-the-barrel CA. Saar

Re: what do you do if CA won't dele The debt is from a state office so I'm sure I couldn't talk them into working out a deal and there is no doubt it is mine. The account is already 2yrs old and from what I've read it won't do me much good to pay it and have it as a paid collection. I don't have a problem paying if it's to my benefit. If I'm wrong in this line of thinking, let me know. Also, I didn't see any letters in the new forum for this type of situation. Re: what do you do if CA won't dele I think you're missing the point. If you acknowledge it as yours when communicating w/ them, you're giving away whatever little leverage you still had. Moreover, if they can prove you did, it would normally reset the SOL. Saar
Re: what do you do if CA won't dele The answer to the problem is indeed simple. 1. send a validation letter 2. 30 days later send an estoppel 3. 30 days later send a demand that they pay the debt and wipe it out due to their failure to properly validate which they will not be very likely to do thereby violating the law. Hope they try to sue you for it without validating the debt. Hope they send you a demand letter without validation. Hope they fail to notify you of the dispute. There are a whole lot of things they commonly do that puts you in the driver's seat demanding they pay the bill and then some and wipe it off the credit bureau files before you actually do sue them for their violations. Before you get through with them, they will most likely be begging to pay the debt for you and wipe it off the credit bureaus too. I just got that done yesterday again for the heaven only knows how many times. Got the proof of the pudding you can see right on line too.

He's got the validation, the estoppel, and some more of them in a multiplicity of examples all posted on the forum to use. They are an excellent place to start learning how to do those things. They should get you started down the road at least.
