What Does this Mean?

    OKâ?¦ I have a question for all the experts again. I recently received a letter in the mail from an attorneyâ??s office saying they represent J.C. Penney and that their client "alleges" that I owe them this debt. They have the mini-miranda on the letter and also indicate that I read the back of the letter. Under â??Important Noticeâ? they basically go into the validation process and add another mini-miranda. There is also a side bar that reads:

    Please note the law allows a telephone dispute. However, our law firm is not legally required to provide verification of the debt, and/or the name and address of an original creditor, unless you dispute the debt, or request the name of an original creditor, in writing

    What the heck does that mean? I'm confused (nothing new there).

    That means that you CAN call, but they are not LEGALLY obligated to respond to a TELEPHONE dispute. I recommend AGAINST CALLING THEM, you could unwittingly offer information that would be a detriment to you, and cause lots of grief.

    You should send a validation letter to them via USMail CRRR, asap. Demand they prove you owe the debt and the amount.

    Sounds like they won't respond unless you write them. That's your best bet anyway, try to talk to debt collectors very little on the phone (if at all).

    Thanks. Makes more sense now. I guess I was just so upset about getting the stupid letter I wasn't actually reading what they were saying. As far as I know, I do not owe them this money. My last recollection was that I had paid them off. I haven't received a bill from them in months much less any threatening letters, so this was rather a surprise. You can bet I will not be calling them for anything. I do not talk with CA's on the phone at all. Makes them just a tad grumpy that I won't pick up the phone. They will be getting a validation letter shortly.
