I have sent a validation request to Gulf State, it is now 31 days & nothing. Are they required to mark dispute on the credit report or is that only the CRA that has to do that when you dispute? It isn't marked but I didn't dispute with the CRA. The acct. was last updated 3/2002. I sent the validation request & received the green card back dated 3/6. Does anyone know if they do their updating at the beginning (b/4 they got my letter) or at the end of the month (after they received my letter- which would be a violation) I guess there is no way to tell. I am going to send the final letter. I somehow doubt they are going be more responsive. If they do not respond to my letter, is it advisable to dispute the line with the CRA's. Am I correct in assuming they can not verify b/4 validating it b/c that would be unvalidated info. Not that Gulf State would care about doing something wrong, but then I would have more ammo to go after them right? TIA for any help you can give me.
No response is considered lack of validation. The reason you try 2nd or estopple is to make certain you have made every attempt to allow them to validate (prove that you owe the debt) before you take them to court for violations. You really do NOT want them to validate. So the answer to the question "what if they don't respond?" is scotch, some ice, and a pat on the back -Peace, Dave
Yes, they are required to mark the collection account as "consumer disputes" or "in dispute" or something similar. Now as far as when during the 30-day timeframe they are required to mark the account as in dispute, I'm not 100% sure. According to Bill Bauer, during his radio show last week, I believe , (and I stress 'believe' because I may have heard him wrong) he said they are required to mark the account in dispute within 5 days of receiving your validation request. I've always suggest pulling your report approx 1 week after the signed date on the green card, and approx 5 days before the 30-day timeframe is up, just to be sure the account was not indeed marked "in dispute".
