I have a couple iquiries on my credit reports that I did NOT authorize. For the past 3 months I have sent letters to the company asking for proof of pp. I never got a response from one, the other 2 sent me a letter and an email saying they have nothing to send me basically. I have now sent an ITS letter to their Registered Agents. It has been 17 days and I have gotten no response from the Registered Agents. I know my next step is to file suit. So my question is, how do I start this process. I have never done it before. What department do I contact at my courthouse, what do I tell them, how much do I sue for? Is it a $1000 violation for each inquiry or $1000 for each inquiry on each CR? I just need to know step by step what I do now. Thank you.
It's $1000 per unauthorized inquiry per bureau. So if they pulled all 3 bureaus, that's $3000. Sorry, I never filed suit, so I don't have answers to your other questions.
are you looking to just get them removed or to actually sue? if you want them removed, dispute online w/the credit bureau (i've had more removed that way than any other) if you wanna sue, call the conciliation court division of your county's courthouse. they will usually mail out the forms and instructions, including filing fees.

Re: Re: What is my next step. call your counties conciliation court division (or the county courthouse main number and they will direct you). ask them how to get the paperwork, cost, etc. suing is the easy part, its collecting that can be difficult.

Meaning, since they pulled a report from eqfx, exp and tu, that would be $3000 worth of violations even though they were pulled on the same day? Correct me if I am wrong. Thanks.
Yummy you are going to have to check with your particular state laws and contact your local small claims court to see what their procedure is.
I checked with them. For the lawsuit to be served I have to either send it restricted delivery or have the sheriff serve it. Anybody have any suggestions on what works better? If I send it restricted delivery and it is going to a corporation, who's attention do you make it to? Also is it the Registered agent that gets served the papers or the company itself? ps. where can I find the opinion letter from the FTC saying that a "click online" doesn't satisfy the requirements for permissible purpose.
I would think that restricted delivery/ return receipt to the registered agent is where you need to send the court summons
