Hi. I recieved a collection letter the end of August & sent out a my validation letter on Sept. 1. They signed for it on Sept. 5. I basically told them, that this wasn't my debt, requested the contract..etc..., told them all contact must be made by mail & failure to provide information would be taken as waiver of any claims against me. Haven't heard another word. This acct. was not on my reports at the time this letter was received. It is now on 2 reports stating account in dispute. I checked my monitor alert on Privacy Gaurd (I had not gotten any notices). I don't know if this alert is a piece of crap or if the CA just put this item on this month & PG hasn't updated yet. But the monitoring page reads "No new activity between 10/01/03 & 12/31/03. If this is correct, that would mean that they inserted this nearly 4 months after they recevied my letter w/o sending me validation. Next step. Should I send another validation wait 30 days & dispute with CRA. Bypass the CA since they already recieved a request for validation, dispute with CRA that the info is not mine, it has not been validated, & they are reporting inacurrate information & see if they remove it w/o dealing with the CA. If they placed it on the report w/o validation but with the notation that it is in dispute, is this a violation for the CA? I have my green card, my original letter, printed copy of PG saying no new activity b/t those dates. Trying to keep up with my paper trail. Thanks for any help. edited to add: I don't know if this makes any difference but when I just looked at my Experian report, under "your statement" it states: "Account information disputed by consumer (Meets requirement of the Fair Credit Reporting Act)"- never seen that one b/4. How does it meet the requirement w/o validation?
I'm bumping this, b/c it has really thrown me for a loop. If it weren't for the dispute notation, I would just request verification from the CRA. The CA put it on w/o validating which would be a violation. But they noted it as in dispute- does that cancel out the reporting violation?
