About 2 weeks ago I sent a validation letter to genesis financial concerning a debt they bought from United Credit bank.I used the validation letter from the sample section My wife calls me just now at work and tells I got a reply from them in the mail. she reads it off to me and they just say they bought the debt and they give the balance and date of last activity and when i opened the account. Nowhere is my signature. No details of payment history. She says it looks like they just filled in the sections from the letter I sent them. Im thinking this isn't close to proper validation but I would like someone to second my opinion. Also I would like guidance on my next step. Im thinking sending a letter demanding deletion since they didnt validate properly. Thanks
Proper validation would include: copies of agreements with your signature copies of statements showing all charges copies of statements showing all payments proof of how they come up with the amount they are trying to collect, including itemization of interest, fees and charges. What they provided is not proper validation. I agree with sending them a demand that they delete the acct form the cra's.
Im home now and had a chance to look at the letter they sent. All it has it type of account, when it opened, date of charge off, My SS #, last payment date and balance. I will be sending them a letter demanding deletion on Thursday. I didnt think this was even close to what validation was supossed to be. Now reading the text of the letter. They say this letter is in response to the debt verification letter I sent them. I sent the letter from the sample letter here on creditnet. I modifed it some but it was basically the same validition letter. they must be pretty stupid or think I am
Either send them another validation letter telling them that the response was not proper validation and give them 15 days to validate or an estoppel letter. Genesis will go away. Charlie
