What is reaging an account?

    Thank you. There is more than one account that changed like that on my report since a few months ago. I guess it's time to get busy with those disputes. Blech.

    IS THIS A POSITIVE OR NEGATIVE ACCOUNT???

    "IF" it is a POSITIVE ACCOUNT...don't worry about it!!!

    "REAGING" does not apply to POSITIVE ACCOUNTS...
    It just has been UP-DATED...

    On my Experian report it falls under "Potentially Negative"

    On my TransUnion it is under Delinquent. My new updated report from TransUnion Reads"

    The following accounts contain infomation which some creditors my consider to be adverse. Adverse account information may generally be reported for 7 years from the date of the FIRST delinquency, depending on your state of residence.

    Sears Roebuck & CO
    Address of C o
    Acct #

    Closed
    Updated 9/03
    Opened 3/91
    Closed 3/03 (not right..was 1/03)

    Revolving Account
    Charge Account
    Individual Account
    Credit Limit: $0

    Status as of 3/2002: paid or paying on as agreed.

    Then it lists the past 48 months worth of deliquency.

    I can only see as far back as March of 97 for any delinquency's. (I know I was late long before 1997 on my payments though)

    Because I can't see further back to see what the date of the first delinquency is I can't argue that the account should be removed already. (Unless there is a way to find this info out that I don't know about)

    Since I can see March of 97, am I correct to assume it should come off at least in March 2005?

    This is the last negative thing left on my TU report so if I can get it off I would love too.

    Nosnip,

    There's nothing in your TU report that shows the DLA. That's why you can't find it.

    This is normal with TU.


    Before you do anything you should call TU Monday morning and ask them when the drop off date is. Since they don't report it, they should, and usually do tell you. Let us know what they say.

    This account IS negative. When they say it "may" be considered negative, it WILL be. The CRA's don't make that decision, the creditors do. So the CRA stays out of that decision. So you'll want this account dealt with.

    There are numerous problems with this TL. Send a letter off to Sears and tell them the reporting is wrong and to correct it immediately. Just don't tell em why it's wrong. Maybe they'll pull your report. Since it's closed that's a No PP case.

    I will call TU tomorrow and work on my letter to Sears later tonight.

    I will most likely post it here to get opinions before I send it off.

    Even though the Sears account was only in my name, we discovered they are reporting it on my husbands credit report also - with experian and equifax. We have disputed it as 'not mine' and are awaiting the results of that.

    Hey NoSnip, I don't believe we've ever talked before but I was going through some old posts looking for some Estoppel info and I read a post you wrote on 09/16.

    You asked if you should tell "so and so" that the SOL in MI is only 6 years?

    ....6 years???

    I didn't want to get off topic here, but I couldn't e-mail you so if you could tell me specifically what SOL you are reffering to, it would be helpful as I am in MI myself.

    I assumed you were reffering to how long one could collect? Give me some details!!! I'm all sorts of excited now!

    SOL for Debt collection in MI is as follows.

    Open Accounts 6 years
    Written Contracts 6 years
    Promissory Note 6 years

    Yeah, thanks. I found that site your reffering to and it says that judgments are 10 years and renewable!

    OMG. I had no idea. Ten years! Wow...

    Am I thinking about it right? It says ten years and renewable for domestic judgments....which means I could be hauled back into court in 9 years and 11 months??

    I called TU and they said that the Closed Date. (3/2002) is the date that it will go by.

    I am working on a letter to Sears right now and will post it shortly.

    I wouldn't mention that the account is closed. Since your goal is to entice them into illegally pulling your CR, you want them to believe that the account is still open and that they have PP to pull your CR (which they don't). Just strike the word "closed."

    Sorry Shelley. I have a huge exam Thursday and will be swamped until then. I haven't forgotten you.

    Now that we know what their internal DLA is we can answer your question. Yes, it's a reage.


    Since they don't report the DLA on your reports often you have to call and ask, especially with TU. But they should tell you rather easily.

    Reaging though is sometimes not such an easy thing to nail down. For example how do you know who did it? The CRA or the DF? They will simply blame each other.

    On a reage issue about the only way to tell is to sue them BOTH and see how it comes out in discovery, and that is a higher court than small claims, usually.

    So here's what I'd do Nosnip.

    Send them a letter telling them to correct the incorrect info. on your credit reports. (but don't tell em what's wrong or which report you're talkin about).

    They'll probably pull a report to see what you're talkin about. When that happens now you have a No PP case and a statutory $1,000 in damages. Sue in small claims and agree to drop your case AFTER they delete the TL.

    If this fails we can go back and argue the reage issue.

    What if they do call me or write me and ask what exactly is wrong?

    What do I do then?

    (letter is all signed, sealed and ready to go to the PO tomorrow)
