Current status- charge off 3-2002(re-aged date) Original delinquency of 95 or 96(30,60,90 late and then collection) Dla- 97 (some payments were made) Chp 7 bk proceedings 3-2002(should be discharged 5-2002) The sol is 7 years. Based on original delinquency of 95 or 96, shouldn't this fall off 2002 or 2003? Or does the Bk allow them to report an additional 7 years from 5-2002?
This is a no-brainer-The judgment will be reported for 7 years from the filing date. The underlying account SHOULD drop off 7 years from charge-off date (remember it was pre-1998) You can dispute the CRA's if the account info stays on longer than the 7 years past the charge-off date.
Well thats kind of what I thought also. I disputed the charge off date which was originally incorrectly reported and they changed the date to 1/2002. (The account was actually charged of in 95 or 96) Every since that dispute each month they report a charge-off as of that current month and a date to fall off exactly 7 years from that date. There is a discussion going on about it at http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&pgnum=1&postid=158376#post158376
I suggest you wait 30 days after your final adjudication to see how the accounts are "dated" once you file BK everything goes into a holding pattern.
