I am in Florida. For sake of argument let's say the sol is 5 years. Does the sol start 12/2004 or 03/2005. Thank you for your help! Here is what my Equifax says: Account Number: -349991113034XXXX Current Status: CHARGE-OFF Account Owner: Individual Account. High Credit: $7,803 Type of Account : Open Credit Limit: $0 Term Duration: Terms Frequency: Date Opened: 1999/04 Balance: $7,928 Date Reported: 05/2009 Amount Past Due: $7,928 Date of Last Payment: 03/2005 Actual Payment Amount: $0 Scheduled Payment Amount: $0 Date of Last Activity: N/A Date Major Delinquency First Reported: Months Reviewed: 1 Creditor Classification: Activity Description: Closed Charge Off Amount: $0 Deferred Payment Start Date: Balloon Payment Amount: $0 Balloon Payment Date: Date Closed: 12/2004 Type of Loan: Credit Card Date of First Delinquency: 12/2004
I've heard the rules are kind of wishy-washy in FL, but I think the SOL is 4 years for credit cards. Anyway, in this case I believe the SOL starts 12/2004 when you first became delinquent. It's kind of strange that it lists your last date of payment for $0 on 3/2005 though. Be careful, these SOL issues are never as clear as they might seem.
To be on the safe sided I always go with the date of "last Activity". So in this case I would go by Date of Last Payment: 03/2005 even though no payment was made. So if your SOL turns out to be 5yrs. instead of 4 (I believe it's 5 years for written contacts in FL) Then you would be covered using Date of Last Payment: 03/2005
