I have searched and seen a couple before but i cant find the right letter. i know at times the responses can get a bit snippy if it appears that someone hasnt made an effort on their on before asking. so for the record i have. Ok now that my disclaimer is out of the way LOL I had two trade lines from the same company (an OC) with two seperate acct #s on TU EXP EQ. disputes were successfull on TU AND EQ. EXP has now called me frivolous. after the second dispute. I have mailed three letters to the company CRRR over 90 days with no response requesting proof two times and the third demanding validation or removal or complaints to BBB and a possible law suit. tomarrow is the 30th day on the third letter. should i send this info to EXP or just proceed with the BBB and give that a chance or what do you guys think? I dont know what the account is to the best of my knowledge but they claim they bought an old GE Capital account of mine. which i paid off over a year ago to a CA who removed the GE tradeline after payment.although that wasnt a condition of payment.
Will, Experian does that all the time. Wait 30 days after your "frivolous" dispute (if it has not been 30+ already) and do an online dispute. It worked for me that way. TU and Eq deleted right away, EX nailed me as frivolous on the second try...or rather "previously verified" and returned to me within 1 week. I waited 30 days, did an online dispute and bam it was deleted. I can not remember if I ordered a new report and used a new confirmation number...I don't think I did...but it can't hurt to use a different confirmation number if you have one. -Peace, Dave
Here is a letter I wrote last year. It worked for me and at least a few others. It is in the letter section as "validation 05". Send it to Exp along with copies of the letters to the oc and copies of the certified mail receipts. Also, you may want to file complaints with the BBB, yours and their state atty general. «Your Name» «Address1» «Address2» «City», «State» «Zip» «Company» «Address1» «Address2» «City», «State» «Zip» «Date» RE: Account #_________/Original Creditorâ??s Name Dear Sir/Madame: This is a request for deletion of a disputed item. I have attempted to have this allleged debt verified by the alleged creditor and collection agency to no avail. I am respectfully requesting that Credit Data Southwest do what is legally mandated by the FCRA and FDCPA, and delete the account listing. Name of Creditor/Agency, Account #_________ On «date», «collection agency» received a demand for validation from me. Attached is a copy of that letter along with the U.S. Post Office return receipt showing they did indeed receive the request. As of today, Dec. 6, 2001, they have failed to provide any proof or respond in any way. On «date», I sent a second letter. Again, I have received no response. Attached is a copy of the letter and the U.S. Post Office showing they did receive that letter. On «date», I sent yet another letter. Again, I received no response. Attached is a copy of that letter as well as a copy of the U.S. Post Office return receipt. The FDCPA states they must cease collection activity until they have produced verification of the alleged debt if so requested. As per the FTC, this includes reporting to the credit bureaus, which they obviously have done illegally. It is quite evident that no such proof of this alleged debt exists or they would have provided it in the previous 4 months since it was requested. Also, when an alleged debt is disputed, a notation must be entered on the debtors report showing the item as in dispute. Again, this was not done. Another violation of the FDCPA. As per the FCRA, if no proof of debt exists, it may not be reported to the credit reporting bureaus. The FCRA also states that the credit reporting agencies must accept written proof from the debtor. Therefore, I am not asking for an investigation to be done, I am requesting that the entry be deleted in its' entirety as there is no proof of its' existence as evidenced by my attached documented proof.
