..when you ask for validation from one CA, and they do not respond BUT passes the account on to another CA?
Do I have any defense against this? Somewhere I read that this would be fuel on the fire of small claims court. Wishful thinking... ::SIGH::
Yes, keep your green cards and when the new CA tries to collect, ask for validation and show them your proof that the former CA couldn't validate. It should be enough to get the new CA off your back.
Love, I know I read on this board somewhere, I'm thinking probably relating to Gulf State/OSI, that once you've sent a validation letter to a CA, that CA, the one that is reporting has to validate. Once validation is requested, there's specific requirements of the CA, blowing you off and passing the buck isn't one of them . If it's not validated, it can't be reported. Passing it on to another CA is continued collection activity. Commonly done, as I understand it, when validation can't be provided. The OC has some obligation in here too, I think it was Doc that posted links to opinion letters that confirmed. I'm looking to see if I saved the information, will post if so. I'm trying to get out of town, keep bumping.

I hate to be a party pooper, but if ca cannot validate, they cannot continue collection activity. That is true. However, there is nothing that says they can't send it back to the original creditor. Then, if the original creditor wants to send it to another ca, they can do that legally. If you doubt what I'm saying, please feel free to call the FTC at 1-877-ftc-help or 1-877-382-4357. I also thought they couldn't do anything til validated. Period. But, when I called the FTC, they straightened me out on that.
