What next??????

    This is the negative information from my husband's equifax report:

    Bankruptcy filed: 01/98 Discharged

    Lien Filed 08/02 State Court Amount:$38,818 Class - Federal

    Lien Filed: 09/97 Amount $42,416 Class - Federal
    Released: 08/99

    Judgement Filed: 11/97 VGC Credit Corp amount $48,261

    Capital One: Opened: 03/99 DOLA: 03/03 High Credit: $2128 Balance: $1995 Previous Payment History: 2 x 30 days late: 10/01 - R2

    Cingular Wireless: Charged off Account - Utility Date opened: 01/00 DOLA: 09/01 Balance: $831

    Wachovia Bank: Account included in Bankruptcy DOLA: 10/97 Date Reported: 02/01

    Wells Fargo Account included in Bankruptcy
    DOLA: 01/98 Date reported: 01/98

    Where should I start now? I have had several things that were not his removed, but I am now down to the more difficult items? Any suggestions?????

    LKH, I understand that the statement by too much was a little bit....too much? But then again, look at the judgments. It was scary for me to even read the whole post.

    Is it one of these times when we should advise a poster to have an attorney review all this mess and see if some of the judgments can't be taken care of?

    It really looks scary.

    In any event, starting over in Canada may not be much of an option since potential mortgagors, etc., will still pull that same Equifax report. :(

    What impact does bankruptcy have upon unsatisfied judgments?

    Alternatively, what usually happens when unsatisfied judgments aren't satisfied?

    LKH (or anyone), what's the best way to get started with this set of circumstances?

    Ok, let's give it a serious shot here:

    The bankruptcy filed in 98 should have included the following:

    - Judgement Filed: 11/97 VGC Credit Corp amount $48,261

    If it didn't, you need to see if an attorney can go back and have the judgement included in the bankruptcy filing.


    Next, let's address the current credit problems:

    -The Capital One late pays should simply be disputed as not being correct. See what happens.

    -The Cingular account is going to have to be settled in return for deleting the account. There's plenty of info elsewhere on this board on how to do that.

    -The Wachovia and Wells Fargo accounts are listed correctly, and shouldn't be bothered with right now.


    Now, that leaves us with:


    The Federal lien.

    Before we handle that, we need some more info:


    Other than the Capital One account and the Federal lien, does he owe any money? How much?

    Is the Federal lien a tax lien, or some other type?

    How much does he make in a year?

    If you can answer those questions, maybe we can figure something out.

    Hi. The federal tax lien is for past payroll taxes from a previous business. He is in the restaurant industry and makes a salary of only about $25k per year. With tips though he makes about $50k per year. I know his CR is scary, but I did know about it when I married him and now just want to try to help him with this and move ahead. Thanks for your help!!

    Oh yeah, he owes Providian about $4000 and Capital one about $2000. We are starting this month to pay extra to one credit card and do the "payment push" to get rid of one credit card at a time. Thanks.

    The VGC was included in the bankruptcy. I don't know if it is being reported as that or not.

    I wouldn't "get rid" of either card just yet. Current payments on them and paying them down will help over time. Keep them current and pay more than the minimum on both.

    And were it me... I'd dispute the two included in bk accounts just to see what happens.

    Been there. Is he making payments? They (used to) show no mercy when he comes to payroll taxes. But this was in the 1980's.

    The IRS has him listed as "uncollectable". They tried to garnish his wages last year if we could not pay them $1000 per month. So, we filled out a form that involved income vs. expenses and they decided he was "uncollectable". This year it may be a different story though because this time they will look at both of our incomes (we were married August, 2002) and I don't think they will have the same result. They definitely do not like to play!
