Hi there. Heres the scoop: tradline on my hubbies reports shows a collection for a medical bill from 2000.It is only $84. I honestly don't think this account belongs to us.I have never even heard of the doctors group listed as the OC. I sent off a settlement agreement to them offering 50% in exchange for deletion. They called today and said that the OC refused to settle for any less then the original amount. So now i plan on sending out a validation since the woman on the phone clearly stated that because it was a med bill that there is no way she could verify it to be mine.(I taped the call on my ans. machine.) Now i know that a tape is not admissible in court, but a transcript of the conversation may be. (i remember a debate on this) -------------------------------------------------------- 1)Should I remind her of the statement she made to me on the phone about it being impossible for her to validate this account? or should i just send out a regular validation? -------------------------------------------------------- I know it is a small bill, but it is the principal of it. I don't owe this money & i refuse to pay a penny of my hubbies hard earned money to these vultures... I offered to pay half knowing it wasn't mine & this lady was rude about it. Now i plan on wasting as much of her time as possible.....lol
Good job Lynn, If you're both in a one party state your tape is admissible. If not a transcript IS admissible. Just don't tell them it's a transcript from a recording. Call the transcript contemporaneous notes. There is NO debate. 1. Do both. Send your demand for validation (crrr) and in it remind them that she admitted they cannot validate. 2. You're gonna waste their time? Don't you know that is harassment? LOLOL Good luck, keep us posted.
Thanks for the reply, I just want to nail this lady for her attitude....lol there is a certain word to describe her that i won't use but it starts with a B....lol Maybe i will get lucky & she'll screw up & violate my rights so i can sue them....hehe I'll let you know what happens....
