What the heck is this??

    Hi all. I've been lurking on this sight for a week or so reading everything I possibly can... trying to make this clean up process as painless as possible... Great info ya'll got here! I'm glad to have found you at this stage in the game.
    Anyway, here's my question on my EQ report in the credit account section is this "tradeline":

    ACCOUNT # : XXXXX
    COMPANY NAME: MARLIN INTERGRATED
    DATE ACCOUNT OPENED: 03/2000
    HIGH CREDIT: $18.00
    MONTHS REVIEWED: 13
    DATE OF LAST ACTIVITY: 04/1998
    BALANCE:$43.00
    CURRENT STATUS: OVER 120 DAYS PAST DUE
    TYPE OF ACCOUNT: OPEN
    ADDITIONAL INFORMATION: COLLECTION ACCOUNT
    ACCOUNT HISTORY WITH STATUS CODES: 09/2003 5 (over 120 days past due)

    This was a bounced check!!! How can it possibly appear as an open account? Is this right? I've never received anything from a CA about it, but I did some research and know that this is another name for NCO. I disputed this with the CRA and it came back verified... now what? I'm sure it's hurting my score, how could it not be it shows an open account 120 days late! Any ideas what to do first/next

    WHO did they verify with?
    AT what address?
    AT what phone number?
    WHAT documentation did they provide?

    They didn't provide anything! Just a letter that says verified on 12/03 Remains unchanged. (EX) and the information on the Equifax says PO Box 8529 Philadelphia PA (888) 660-3234

    Now what? Should I write to the CA and ask for validation even though they've never contacted me? Do they even have to provide it since there's never been any contact there is not a 30 day window for me to reqeuest validation.:(

    WHAT ADDRESS???
    WHAT PHONE NUMBER???

    WHAT PROOF DID THEY PROVIDE???

    That's what I've just said they did not send me any proof. Do I need to request this? Sorry, just starting out!

    thank you , I will do that.
    I have one more question... If I know for fact tha a CA has re-aged an account to when they purchased it from it's original DOLA do I need to create a paper trail first or should I just send them a letter of ITS for FCRA(?) violations, also are there any samples of this just so I can get an idea of what to say.
    Is it a $1000 violation for each CRA they reported to or just one violation regardless of if it's on all 3?

    Thank you! I could practically double my salary this yr just suing for FCRA and FDCPA vioiations between me and my dh's reports...hee hee of course I'd much rather just clean up this mess and have them delete all their mistakes:)

    why do you need this TL off? are you going to buy a house or something? Its really old, ready to fall off on its own in a year, and probably not going to boost your score all that much if its removed. whatever the reason, i totally understand that you just want it gone now.

    Send a validation demand and wait and see what happens.

    be nice in your letter. dont let on that you know what youre doing. dont copy & paste the val letter, but tailor it to your situation.

    something to the effect of: "i checked my reports, and i dont recognize this entry, this must be a mistake, i've never received anything from your agency, maybe you have the wrong person, what is this for?...etc...."

    now, if a mortgage lender has told you to take care of this TL and youre in a huge hurry, you may just have to pay it (its a small amount) and live with the TL for another year. No biggie. You could get lucky and get a deletion in exchange for paying the debt in full, but since its such a small amount, i wouldnt count on that. make any deals in writing. not over the phone.

    Ya know, I am going through the EXACT same thing with Marlin. The only difference is mine is for $80 and the DOL is 4/2000. They have never ever contacted me either! I am guessing it is mine because it is from a period in my life where I let EVERYTHING slip. But they've never contacted me, and I only found out by my CR. I'm currently disputing it on Eq as "not mine", and if that doesn't work I'll go the validation route.

    I noticed the above and remembered something: According to FTC opinion, listing something on your reports without contacting you directly by phone or mail is considered their initial contact. In other words, there was contact, just indirect. Some people have construed this to mean they violated your rights by not sending you a letter or calling you within 5 days of this "communication". they're supposed to let you know that you have a debt, how much its for, who the OC is, and that you have the right to dispute its validity. The 30 day thing is really meaningless. its just that they claim that they will consider the debt valid if you dont dispute it within 30 days. doesnt mean it IS or BECOMES valid if you dont dispute. Certainly doesnt mean its valid if you NEVER GOT THE CHANCE to dispute.

    DId you notice that?

    6* I'm awaiting my green card :) I sent VL out the other day.

    1*No in my late night haze I never noticed the dates not matching up. Or if I did I probably chalked it up to the weird way the CRA's report things...


    Does ANYONE understand how to figure the DOLA that is being reported if it doesn't come up on the copy that the CRA sent out??????
    ex. a medical bill from 12/98 the only dates on the report are
    TU updated: 10/2002
    placed: 10/2002
    EX date opened/reported since 10/2002
    date of status/last reported 10/2002

    when I called EX they said it shows as 5/99 (6months from the day the debt was opened/closed since it was a medical bill) but how would I know that from the report? How can I tell if it's been re-aged?? and why does the PG analysis say that it's effect on my score is "high"?

    WOW the're quick. NCO sent out a letter the day after i received the Green card and I go their letter today. Basically in response to my VL they say "we have been unable to locate the matter you have referenced" "please provide further identifying information such as your ssn, acct # and billing address"

    A quick recap for those who don't want to scroll up. This is a bounced check from 1998 for $18.00. They are reporting it as an open revolving acct. that is 120days past due.

    So do I send them the info? Do I play hardball and say if you can't locate the info how did you verifiy with the CRA that it is correct? Do I tell them it's not my responsibility to help them validate?
    Any ideas appreciated.
