Okay, I just got my TU Report back. since October 26, 2001 and today, my score has gone from 435 to 567. I am desperately trying to make 600 club by May. here are my negs(I have others but these are the ones that have the most potential) collection record mutual hospital #xxxxx verif'd 2/2002 placed 07/2001 balance: $93.00 most owed: $92.00 past due: $92.00 This should be marked as "in dispute and isn't" i sent validation and c&d but they still continued collection activity. there is another ca account for $139.00 with ths same creditor my usa funds student loan listed as paid charge off due to come off 09/02 i disputed it and it came back verified first national bank SD cancelled by credit grantor updated 02/2002 1x90 days late, 3x60 days late, 4x30 days late max deliquency in 4/2000 balance 0 I closed this account when i paid it off in November. I am sending a nutcase letter because i actually did try simple dispute with cra and of course they verified. Which deletion will give me the biggest jump, and which one is more likely to be deleted. I am thinking I have enough on the ca to file suit? but if anybody has anyother ideas, i would appreciate it>
If the CA (furnisher) has not placed the account in dispute after you have written them and stated you are disputing the account, yes, they are in violation of the FCRA. Have you written the Attorney General and BBB of their state yet? Also, whoever licenses them, for instance in Oregon it would be the Consumer Finance Department. They are actually the best to go after because they can take away their license to operate. You want to go after the consumer ally that can do THEM the most damage. Send them (dated) proof that you disputed the account, the piece from the FCRA that states they have to place it in dispute and the (dated) non disputed item from your credit report. That will definitely light some fires in some Compliance Manager's office. I have gotten rid of 2 paid collections and placed one unpaid collections in "no status" land... Oh - and definitely use the Christine Baker methodology of faxing rather than CRRR, it's cheaper, faster, and you have better proof it was sent.
