What to do next on Old Collection

    My husband has an old collection from a phone company, about 950.00, it is almost 6 yrs old. Not paid, it is only showing on Trans Union. We have disputed and disputed, but it comes back as verified every time. At first we disputed as "Not mine" because we didnt recognize the company name because it was sold. It came back verified.

    I have contacted the collection agency directly, I want them to provide detailed info on what this was for, detailed statements, etc. He says this debt is so old, they wont go thru the time and money it'll take to get the info, that its not worth it.

    What should I do next? We are in the process of buying our house, our mortgage broker says that we have been pre-apprvd even with it on there, but at final apprvl, we may end up having to pay it at closing, but we wont know for sure for awhile. Our closing isnt until July because we are having the house built, but I really want to try to get this resolved before then, just in case we can get this removed.

    where should I go from here?

    For a mortgage you may not have a choice but to pay it.

    If you have time, send a validation letter to the CA, send it CRRR (Certified Mail return receipt) - give them 30 days to validate it (Computer printouts don't count - you need a sig).

    If they don't respond, send the Estoppel letter CRRR, if after 15 days they don't respond then dispute with TU, send them copies of the green cards and ask that it be removed since the CA couldn't/wouldn't verify that the debt is valid.

    Again, since you don't have a lot of time, you may not have a choice...

    I have copied a letter for validatiion that I will be sending today, we have until July, so I hope everything goes well. I was reading a thread here a few minutes ago. This phone debt was sold to NCO also, amazing. (people were just talking about NCO) I had never heard of them.

    Maybe it's just me. And probably 'cause I'm such a smart-ass. But I would ask the CA if it's worth their time and money to bring that info into court! I'm so sick of these CA's talking to people like that. I'll bet if Judge Small-Claims wanted it he'd get off his lazy cheeks and get it. Go ahead and try everything dfwgt suggests. But if it runs into June, see what you can get by pushing your legal "might" around. There's always something they can do! Just my thoughts.

    You have an EXCELLENT chance that they won't validate, since they TOLD you it's so old, they won't be able to find ANY proof (phone co usually purge files after 2 years)

    Wow, I never thought of that! I just copied the validation letter in the sample letters, and I will be sending it certified with Retnd Recpt in the morning, then I give them 30 days right? After 30 days, do I send another letter, or go to the credit bureau directly?
