Hello group! I am new to this group, and I have been researching credit repair for the past several months. Two years ago I had to file BK, so I am very interested in improving my credit file as much as possible. I recently began the process by disputing 4 trade lines with the three CRA's. Two of the four were verified, but now reflect as positive trade lines instead of negative. The other two were verified, and I'll re-dispute those at a later date. I have a question as to how to properly deal with a particular CA. My Equifax CR revealed a charge off that I didn't know existed, and am not sure if it is a legit debt. My Experian CR shows the same charge off, and a valid charge off listed TWICE under different account numbers. All of these charge offs are reported by the same CA. Here is the action I have taken so far- 1. I mailed a validation letter to the CA requesting validation for both charge offs. I received a response saying 'accounts were included in BK, dispute with your consumer reporting agency if inaccurate'. This is only partially true, but only one account was included in my BK. This is all the notice said, no other effort was made by the CA to validate either debt. 2. I disputed the unknown charge off with Equifax. The CA verified the debt with Equifax and now shows it as 'included in BK.' What action should I now take concerning the unknown charge off? It was NOT included in my BK, and they did not validate the debt. Also, what action would be appropriate concerning the other charge off, which is listed TWICE on my Experian report with the CA using different account numbers? This is making it appears as two separate charge offs. The CA still technically has until March 4 to respond to my validation request, although I don't expect I'll get any other reply from them. Thanks in advance for all responses!
I have been giving this some thought, and want to get advice on a course of action. My thoughts are to attempt to validate the charge offs once again, so that the CA will have failed twice (assuming they give me the same brush-off response) and will show more than one violation if I am forced to send an ITS letter. I will then press Equifax and Experian for removal of the charge offs based upon the two failed attempts to verify with the CA. Does this sound like a reasonable approach? I am assuming that I'll end up litigating to get this corrected, and want to show that I made more that one effort to fix it, and the CA failed after multiple chances, thus I exhausted all efforts before court action. Thanks in advance for any responses! MrKee
Another question! Would the CA have permissible purpose to pull my file, in response to my request to validate? Thanks! MrKee
I'm no expert but a CA must cease collection activities of disputed accounts. Pulling a CR would be a violation. low
