we sued the providers of Fake-o's because we applied for credit based on the information they provided us, but were denied, and therefore our scores were lowered, resulting in damages due to having to pay higher interest rates? What do you think?
great idea! But I think you only have a case against equifax, since they claim they provide your real FICO score. Creditexpert and TU never mention FICO, and if even one lender does use their score, they're in the clear. -Roman
Something tells me that the fine print you get with the fake-o scores pretty much indemnifies them against legal action should you "misuse" their scores. I'm sure they would contend that these scores were clearly marked as being for consumer education and edification only and are neither intended for, nor are ever used by, lenders who make credit-related decisions. Call me a party-pooper, but don't call me late for dinner (per Henny Youngman, I'm sure). Doc
